ByteDance and TikTok ask for temporary suspension of US ban

DNVN - TikTok, the popular short video app, and its parent company ByteDance filed a lawsuit on December 9, asking the US Court of Appeals for the District of Columbia to temporarily suspend the implementation of the law forcing ByteDance to sell its shares in TikTok before the January 19 deadline. This request is to wait for the final decision from the US Supreme Court.

The emergency filing by the two companies states that without timely intervention, the law could lead to TikTok being shut down just before the presidential inauguration. In the filing, TikTok asserts that it is an important communication platform in the US with more than 170 million monthly active users.

Failure to grant a stay could result in TikTok being banned in the US in as little as six weeks, causing a huge loss of value for ByteDance and its investors, and severely impacting many businesses that rely on TikTok to drive sales.

A three-judge panel on the appeals court previously upheld ByteDance’s divestment request, giving it until early 2024 to comply. Failure to do so would have seen ByteDance face a ban on TikTok across the United States.

ByteDance and TikTok’s legal teams have expressed confidence that the Supreme Court will review the case and reverse its ruling, and have stressed that the delay is necessary to ensure more time to thoroughly address the legal issues.

The companies also pointed out that President-elect Donald Trump has pledged to block the ban, and they said the delay would allow the new administration to reevaluate and clarify its policy stance.

In addition, TikTok warned that the ban would not only have domestic impacts but would also cause major disruptions to its services for millions of users globally. TikTok explained that it relies on hundreds of US-based suppliers to support services such as maintenance, app distribution, and software updates. If the ban takes effect from January 19, these suppliers will not be able to continue to support it, causing great difficulties in operating the platform. This will disrupt operations, making it impossible for TikTok to update new features or fix technical errors, directly affecting users outside the US.

TikTok wants the Court of Appeal to make a decision on the stay request by December 16 to ensure reasonable time to resolve the matter.
