Ministry of Construction: Many old apartment buildings have cracks and tilts after super typhoon Yagi

The Ministry of Construction has just issued Official Dispatch No. 5297 on the implementation of the Housing Law 2023 and Decree No. 98/2024 of the Government on renovation and reconstruction of apartment buildings (Decree No. 98) to ensure the safety of people's lives and property during the 2024 storm season.

The ministry said that recently, many northern provinces and cities of Vietnam have been greatly affected by super typhoon Yagi, causing flooding in some localities and huge losses in human lives and property.

In some places, many old apartment buildings that are being renovated and rebuilt have cracks and tilts, making them unsafe for continued use. Due to the impact of the storm, some localities have had to evacuate residents from their apartment buildings to ensure safety.

According to statistics, the country currently has about 2,500 old apartment buildings built before 1994, mainly concentrated in Hanoi and Ho Chi Minh City, many of which, according to inspection results, need to be renovated and rebuilt.

The Ministry requested the People's Committees of provinces and centrally run cities to urgently carry out the tasks assigned in the 2023 Housing Law and Decree No. 98/2024 of the Government, detailing a number of articles of the Housing Law on renovation and reconstruction of apartment buildings.

People's Committees of provinces and cities must immediately implement solutions to relocate people from old, dangerous, degraded apartment buildings that must be demolished according to regulations, and arrange temporary accommodation for households that must be relocated to ensure the safety of people's lives and property.

In addition, localities need to urgently organize the inspection and assessment of the quality of old apartment buildings in the area. For apartment buildings that have completed inspection and assessment of quality but are subject to renovation and reconstruction but have not yet been included in the renovation and reconstruction plan of the apartment building, a plan for renovation and reconstruction of the apartment building must be established according to the provisions of the Housing Law 2023 and Decree No. 98/2024 as a basis for project implementation.

People's Committees of provinces and cities urgently organize the establishment and approval of 1/500 scale planning for areas with apartment buildings that need to be renovated and rebuilt so that investors have a basis to participate in developing investment plans, compensation, support and resettlement plans when registering to be project investors.

The People's Committees of provinces and cities urgently develop and approve plans to renovate and rebuild apartment buildings that must be demolished for renovation and reconstruction with contents according to the provisions of the 2023 Housing Law and Decree No. 98 of 2024.

In addition, localities need to determine the coefficient K for apartment area compensation applicable to each area and location with apartment buildings built before 1994 that need to be renovated or rebuilt. On that basis, the project owner and investor will agree on the area to be compensated according to coefficient K to include in the compensation and resettlement plan.

The Ministry also requested that the People's Committees of provinces and cities organize the selection of investors to speed up the implementation of projects to renovate and rebuild apartment buildings according to regulations, and at the same time organize training and widely disseminate information to all levels, sectors and people living in areas with old apartment buildings that need to be renovated and rebuilt to create consensus and widespread participation of the people.

Hanoi and Ho Chi Minh City have many old apartment buildings that need to be renovated and rebuilt, but up to now, procedures in the project preparation phase such as approving compensation, support, and resettlement plans; land allocation, land lease, and construction permit issuance have not been completed.

This Ministry proposes to promptly complete procedures for investors to promptly implement urgent project construction, arrange resettlement for people, and ensure the rights of apartment owners and project investors based on regulations.
