Ministry of Construction proposes that the government must be responsible for urban development

(CLO) The Ministry of Construction is seeking public opinions on the draft Law on Urban Development Management to create conditions and premises for gradually developing urban areas towards green and smart urban areas.


The Ministry of Construction said that the great achievements of the renovation process have had a profound impact on the urban development of our country in recent times, helping it achieve important development milestones.

The urban system nationwide has rapidly increased in number, forming urbanized areas along with urban chains and clusters distributed widely across regions. If at the end of 1998, the whole country had only 633 urban areas with an urban population of only 24% of the country's population, then after 10 years the number of urban areas had increased to 740 urban areas. By December 2023, the whole country had 902 urban areas with an urbanization rate of about 42.7%. The total number of urban areas from type IV and above reached nearly 200 urban areas compared to 86 urban areas in 1998. The quality of life in urban areas has gradually improved.

Urban development creates a synchronous and modern infrastructure foundation for urban areas, creates favorable conditions and strongly promotes socio-economic development, shifts the economic structure and labor structure towards industrialization, modernization, innovation of growth models and economic restructuring, contributing to ensuring national defense and security.

Besides the achievements, the current status of urban development in Vietnam has major shortcomings and limitations affecting sustainable development, which need to be focused on overcoming:

The urban distribution in Vietnam's urban system still lacks connectivity, is not clearly decentralized, has not promoted regional connectivity in the urban system, and the application of new, sustainable development models still lacks depth. Regional factors, characteristics, and features of urban areas have not been promoted, creating comparative advantages for urban areas in organizing urban development according to planning.

The organization of urban construction and development according to planning is still weak, not linked to resources, and is still scattered. Urban expansion is still common. Old residential areas in urban areas are still slow to be renovated, renovated, and redeveloped, especially areas with substandard infrastructure, dilapidated housing areas, urban poor residential areas, and areas not suitable for urban functions. Resources and participation of the community and urban residents have not been promoted.

Infrastructure in large urban centers is overloaded, not adapted to climate change, and unable to respond to large-scale epidemics; connectivity is still weak. In large cities, some technical infrastructure indicators (urban traffic, trees, drainage, wastewater treatment) and urban social infrastructure do not meet requirements, reducing urban quality.

Underground space exploitation is still very limited, not yet promoted and exploited effectively; has only received attention for development in recent years, the scale and quantity are still limited, localized, only exploited for a specific purpose, there is no overall connection for the whole area or an urban area, not yet managed and exploited effectively, systematically in urban areas.

The capacity for urban management and administration is still weak, slow to innovate, modernize, apply technology and digital transformation in management. The role and management responsibility of local authorities has not been promoted in conjunction with improving the capacity and level of management and promoting the participation and implementation of the community in urban development management.

Faced with this situation, the Ministry of Construction proposed to develop the Law on Urban Development Management based on the viewpoint of institutionalizing the Party's guiding viewpoints and the State's policies on the construction and sustainable development of Vietnamese urban areas and the task of perfecting institutions and building a system of legal regulations in the current period.

The Law on Urban Development Management will ensure the constitutionality, legality, unity, uniformity and effectiveness of the legal system. Inherit, promote and legalize regulations that have been proven to be appropriate and effective in practice. Selectively refer to legal regulations of a number of countries and international organizations in the world that are suitable to the practical development situation of Vietnam and the trend of international integration.

Developing a sustainable urban system according to the network, with reasonable distribution, suitable for each region, ensuring synchronization, unity, and balance between regions; urban areas are formed, newly built, operated, developed, renovated, renovated, and reconstructed in an orderly manner, according to planning and with a plan, in which urban planning and urban infrastructure development must be one step ahead; protecting, using natural resources economically and effectively, especially land resources.

Create conditions and premises to gradually develop urban areas towards green, smart urban areas, adapting to climate change, preventing and combating natural disasters and epidemics; forming and developing livable urban areas for residents and attractive to investors, with a role and position as a driving force leading socio-economic development.

Promote the role and responsibility of urban authorities, residential communities and socio-political organizations participating in urban management, implementing decentralization and delegation of power, and improving the efficiency and effectiveness of state management of urban development.
