Some National Assembly deputies proposed to reform the organization of local governments in the context of restructuring and streamlining the apparatus. Minister of Home Affairs Pham Thi Thanh Tra suggested to keep it as it is because the overall assessment is still ongoing.
On the morning of February 15, the National Assembly discussed the draft Law on Organization of Local Government (amended).
The draft Law is revised in the direction of maintaining the local government organization model as in the current law. All administrative units at all levels, local government organizations include People's Councils and People's Committees, except in specific cases that the National Assembly stipulates are not local government levels.
Delegate Pham Van Hoa (Dong Thap) agreed with the proposal to have both People's Council and People's Committee, in which "it is impossible not to have People's Council at the commune level".
In the past, some localities piloted the urban government model, so Mr. Hoa suggested studying and implementing it nationwide. "It cannot be implemented only for centrally-run cities while provincial cities are also urban areas," Mr. Hoa said.
Delegate Tran Quoc Tuan (Tra Vinh) said that the principles of organization and operation of local government are important and principled content on the organization and operation of local government.
The law is designed according to the guiding thinking of the Party and State: "locality decides, locality acts, locality is responsible" and "strong decentralization and delegation of power to unleash resources for national development". If the content of this law lacks effective and efficient institutions and mechanisms to control power when local governments are strongly decentralized and delegated, negative situations may occur, and even worse, the degeneration of state power.
Therefore, the delegate suggested adding to the bill the principle of "strengthening control of power when it is decentralized, delegated, and authorized".
Mr. Tuan suggested that it is necessary to study the direction of innovating the organization of local government in urban areas to promote development. Currently, a revolution is being carried out to streamline the apparatus to operate effectively and efficiently, but studying the content of the draft Law, he feels that he is not really assured.
Through Party Congresses, many policies, guidelines and directions of the Party have directed the innovation of the organization and operation of local governments in accordance with the characteristics of urban areas and rural and island areas. After amending the Law on Organization of Local Government in 2019, localities such as Da Nang, Ho Chi Minh City and recently Hai Phong were allowed by the National Assembly to implement urban government. These places have implemented and brought about very good results.
Therefore, delegate Tuan said that in the context of streamlining the apparatus, local government organizations also need to be carefully considered and redesigned appropriately.
Delegate Ha Sy Dong (Acting Chairman of the People's Committee of Quang Tri province) said that the provisions in the draft Law are not innovative, contrary to the current trend of streamlining the apparatus.
In the context of the ongoing revolution to streamline the organizational apparatus, local government organizations also need to be redesigned to suit the characteristics of urban and rural areas.
He suggested that while the local government organization in rural areas has not been innovated, it is necessary to strongly innovate the local government organization in urban areas to promote development.
Explaining later, Minister of Home Affairs Pham Thi Thanh Tra said the focus of this law amendment is to define and clarify the decentralization, delegation of power, and authorization to local authorities in the spirit of "locality decides, locality acts, locality is responsible".
Along with that, build mechanisms, create a tight legal corridor, remove obstacles and bottlenecks in specialized laws, ensure the smooth implementation of the principles of decentralization, delegation of power, and authorization of the Law on Organization of the Government and the Law on Organization of Local Government.
"If there is no legal mechanism to resolve this, it will be very difficult. But there are immediate stability issues to ensure the smooth operation of local governments during the process of restructuring the apparatus.
"If we adjust this issue or that issue, we will not be able to achieve connectivity and unity to streamline the organizational apparatus," Ms. Tra pointed out.
Regarding the organization of local government and the model of local government, the Minister said that it should remain as it is because the overall assessment of the model of the entire political system is still ongoing. She said that there will be adjustments and arrangements so it should remain as it is for now.
"If it is not temporarily maintained, there will be a gap in the operation of the local government organization system and local government model," the Minister emphasized.
For localities that are piloting urban government (not organizing district and ward People's Councils) according to the National Assembly's resolutions, they can still continue to implement it, "without any problems".
"The Ministry of Home Affairs is coordinating with the Central Organizing Committee to evaluate and study the overall organizational model, including the local government system, so we would like to ask for delegates' permission to support the temporary plan to keep it the same," the Minister shared.
