On the basis of inheriting the 2012 Trade Union Law, the draft Trade Union Law (amended) consists of 6 chapters, 36 articles (amended and supplemented 32 articles; added 4 new articles), removing 1 article compared to the 2012 Trade Union Law.
The draft Law expands the scope of regulation to “people working without labor relations in Vietnam” to protect this vulnerable group, and at the same time adds the issue of joining “employee organizations at enterprises” into the Vietnam Trade Union; the relationship of coordinating activities and the issue of sharing union funds with this organization.
In addition to the subjects under the 2012 Trade Union Law, the draft Law adds the subject of application which is the organization of employees at enterprises (for joining the Vietnam Trade Union).
The draft law will give more initiative to the Trade Union organization in personnel work (Article 26) in the direction: The competent authority decides on the number of full-time trade union officials who are cadres, civil servants, and public employees after agreeing with the Vietnam General Confederation of Labor; at the same time, it allows "the Vietnam General Confederation of Labor to decide on the number of full-time trade union officials who are employees under labor contracts in specialized trade union agencies and grassroots trade unions in accordance with the requirements of the tasks".
Regarding the rights and responsibilities of higher-level trade unions in places where there is no organization representing employees at the grassroots level, the draft Law has amended the provisions on the rights and responsibilities of higher-level trade unions in places where there is no organization representing employees at the grassroots level, in accordance with the provisions of the 2019 Labor Code and the role of a socio-political organization according to Article 10 of the 2013 Constitution./.
