Supplementing regulations on capital sources for the announcement and adjustment of planning

The Government has just issued Decree No. 22/2025/ND-CP amending and supplementing a number of articles of Decree No. 37/2019/ND-CP dated May 7, 2019 of the Government detailing the implementation of a number of articles of the Law on Planning, which has been amended and supplemented by a number of articles according to Decree No. 58/2023/ND-CP dated August 12, 2023.

In which, Decree No. 22/2025/ND-CP amending and supplementing Article 3a of Decree No. 37/2019/ND-CP has been supplemented in Clause 2, Article 1 of Decree No. 58/2023/ND-CP as follows:

Other legal sources of capital for planning establishment, announcement and adjustment

1. Other legal sources of capital for planning establishment, announcement and adjustment include support resources from domestic organizations and individuals and foreign organizations and individuals as prescribed in Clause 2 of this Article.
2. Support resources from domestic and foreign organizations and individuals include funding; research results of agencies, organizations, experts; sponsorship of awards for organizations and individuals with planning ideas selected based on the results of the planning idea competition organized by the planning agency (if any); support for organizing conferences, seminars, training, research, surveys, training; planning products; documents serving planning are received, managed and used as follows:
3. a) Financial support resources from domestic agencies, organizations, individuals and foreign individuals are received, managed and used in accordance with the provisions of the law on state budget;
4. b) Support resources from foreign agencies and organizations are received, managed and used in accordance with the provisions of law on management and use of official development assistance (ODA), preferential loans and non-refundable aid not included in official development assistance from foreign agencies, organizations and individuals for Vietnam;
5. c) Support resources in the form of research results of agencies, organizations, and experts; sponsorship of awards for organizations and individuals with planning ideas selected based on the results of the planning idea competition organized by the planning agency (if any); support for organizing conferences, seminars, training, research, surveys, and education; documents serving planning are received, managed, and used in accordance with the provisions of the law on planning and other relevant laws;
6. d) For resources supported by products such as planning documents and planning adjustment documents, the sponsor decides on the implementation costs, the form of selecting a consulting organization to prepare the planning, and the form of selecting a consulting organization to prepare and adjust the planning.

Principles of support and use of other legal capital sources for planning establishment, announcement and adjustment

Voluntary; not for the benefit of the sponsor to affect the common interests of the community and society; not for profit.

Ensure objectivity, publicity, transparency; correct goals and purposes; economical and effective.

Add criteria for ad hoc assessment of planning implementation

Decree 22/2025/ND-CP also adds Article 6a after Article 6 of Decree 37/2019/ND-CP on criteria for ad hoc assessment of planning implementation:

General assessment of the implementation of development orientations for sectors, fields and organization of socio-economic development space in the national master plan, national marine space planning, national land use planning; development orientations for sectors, fields and organization of socio-economic development space in national sectoral planning, regional planning; development plans for sectors, fields and organization of socio-economic development space in provincial planning.

Evaluate the implementation status of projects according to the following contents: a) List of projects that have been and are being implemented; b) List of expected important projects and priority projects in the planning period that have not been implemented; reasons.

General assessment of the results of implementing socio-economic indicators in the planning; difficulties, obstacles and causes affecting the results of implementing the planning; proposing solutions to improve the effectiveness of implementing the planning; recommending adjustments to the planning (if any).
