At its 25th session on August 14th, chaired by National Assembly Chairman Vuong Dinh Hue, the National Assembly Standing Committee considered and approved the draft Resolution amending and supplementing several articles of Resolution 657/2019/UBTVQH14 dated March 13, 2019, of the National Assembly Standing Committee, which specifies the positions and titles of People's Public Security officers with the highest ranks of Lieutenant General and Major General, not yet stipulated in the Law on People's Public Security.
Speaking on behalf of the drafting agency, General To Lam , Minister of Public Security, presented the draft resolution, stating that, based on Clause 2, Article 25 of the 2018 Law on the People's Public Security, the Standing Committee of the National Assembly issued Resolution No. 657 to specifically stipulate the positions with the highest ranks of Lieutenant General and Major General at points c and d, Clause 1, Article 25 of the Law on the People's Public Security.
On June 22, 2023, at the 5th session of the 15th National Assembly, the Law amending and supplementing a number of articles of the Law on the People's Public Security Force was passed. This included amending and supplementing point d, clause 1, Article 25 regarding the number of positions with the highest rank of Major General, from 157 to 162 positions.
Therefore, amending and supplementing Resolution No. 657 is necessary to specifically stipulate that the five positions with the highest rank of Major General are designated.
The purpose of the amendment is to improve the legal basis for the highest rank, Major General, in order to confer and promote the rank of Major General in the People's Public Security, ensuring consistency and uniformity in the Law on the People's Public Security.
At the same time, it also aims to institutionalize the Party's viewpoint on building a truly clean, strong, professional, elite, and modern People's Public Security force, meeting the requirements and tasks in the new situation...
To ensure that the resolution takes effect at the same time as the Law amending and supplementing a number of articles of the Law on the People's Public Security, the Government submitted Proposal No. 331 dated July 10, 2023, requesting the Standing Committee of the National Assembly to allow the application of simplified procedures in drafting and promulgating the resolution, and to include it in the agenda of the August 2023 session for consideration and approval.
On July 26, 2023, the Secretary General of the National Assembly issued Notice No. 2655 regarding the conclusions of the Standing Committee of the National Assembly agreeing with the Government's proposal. On August 6, 2023, the Government issued Resolution No. 19 approving the draft resolution.
The Resolution takes effect from August 15, 2023, to ensure it takes effect simultaneously with the Law amending and supplementing a number of articles of the Law on the People's Public Security.
Presenting the verification report, Chairman of the National Defense and Security Committee Le Tan Toi expressed agreement with the necessity of issuing the resolution for the reasons stated in the Government's submission to ensure the effective implementation of the Law amending and supplementing a number of articles of the Law on the People's Public Security.
The draft resolution complies with the procedures and regulations of the Law on the Promulgation of Legal Normative Documents. The provisions of the draft resolution are consistent with the Party's policy on building the People's Public Security force, the provisions of the 2013 Constitution, ensuring consistency and uniformity within the legal system and the feasibility of the law.
During the session, the Standing Committee of the National Assembly unanimously agreed on the necessity of issuing a new resolution specifically defining the positions and titles of People's Public Security officers with the highest rank of Major General, which is not yet stipulated in the Law on People's Public Security.
At the meeting, 100% of the members of the National Assembly Standing Committee unanimously voted in principle to approve the draft resolution. They also instructed the Secretary General of the National Assembly to coordinate with the drafting and reviewing agencies to revise and finalize the resolution for signing and promulgation.
