At the 25th session, on August 14, chaired by National Assembly Chairman Vuong Dinh Hue, the National Assembly Standing Committee considered and approved the draft Resolution amending and supplementing a number of articles of Resolution 657/2019/UBTVQH14 dated March 13, 2019 of the National Assembly Standing Committee, specifically stipulating the positions and titles of people's public security officers with the highest ranks of Lieutenant General and Major General, which have not been specified in the Law on People's Public Security.
On behalf of the drafting agency, General To Lam - Minister of Public Security - said that, based on Clause 2, Article 25 of the 2018 Law on People's Public Security, the National Assembly Standing Committee issued Resolution No. 657 to specifically stipulate the positions with the highest ranks of Lieutenant General and Major General at Points c and d, Clause 1, Article 25 of the Law on People's Public Security.
On June 22, 2023, at the 5th Session, the 15th National Assembly passed the Law amending and supplementing a number of articles of the Law on the People's Public Security. In which, Point d, Clause 1, Article 25 on the number of positions with the highest rank of Major General was amended and supplemented from 157 to 162 positions.
Therefore, it is necessary to amend and supplement Resolution No. 657 to specifically stipulate the 5 positions with the highest rank of Major General.
The purpose of the amendment is to perfect the legal basis for the highest rank of Major General to implement the conferment and promotion of the rank of Major General of the People's Public Security, ensuring consistency and unity in the Law on the People's Public Security.
At the same time, it also aims to institutionalize the Party's viewpoint on building a truly clean, strong, disciplined, elite, and modern People's Public Security force that meets the requirements and tasks in the new situation...
To ensure that the resolution takes effect at the same time as the Law amending and supplementing a number of articles of the Law on People's Public Security, the Government has issued Document No. 331 dated July 10, 2023, requesting the National Assembly Standing Committee to allow the application of simplified procedures in drafting and promulgating the resolution, and include it in the August 2023 meeting agenda for consideration and approval.
On July 26, 2023, the Secretary General of the National Assembly issued Notice No. 2655 on the conclusion of the National Assembly Standing Committee agreeing with the Government's proposal. On August 6, 2023, the Government issued Resolution No. 19 approving the draft resolution.
The Resolution takes effect from August 15, 2023 to ensure it takes effect at the same time as the Law amending and supplementing a number of articles of the Law on People's Public Security.
Presenting the review report, Chairman of the National Defense and Security Committee Le Tan Toi expressed his agreement with the necessity of issuing the resolution for the reasons stated in the Government's Submission to ensure the effectiveness of the Law amending and supplementing a number of articles of the Law on People's Public Security.
The draft resolution dossier is in accordance with the order, procedures and provisions of the Law on Promulgation of Legal Documents. The provisions of the draft resolution are in accordance with the Party's policy on building the People's Public Security force, the provisions of the 2013 Constitution, ensuring consistency and unity in the legal system and the feasibility of the law.
Discussing at the meeting, the National Assembly Standing Committee highly agreed on the necessity of issuing a new resolution specifying the positions and titles of People's Public Security officers with the highest rank of Major General, which is not yet stipulated in the Law on People's Public Security.
At the meeting, 100% of the members of the National Assembly Standing Committee voted in principle to approve the draft resolution. At the same time, the Secretary General of the National Assembly was assigned to coordinate with the Drafting Agency and the Reviewing Agency to revise and finalize the resolution for signing and promulgation.
