The Ministry of Home Affairs' latest proposal on the appointment process for civil servants holding leadership and management positions

In particular, the Ministry of Home Affairs proposed to supplement regulations that commune-level cadres and civil servants and those who used to be cadres and civil servants at the district level or higher and were then transferred or rotated to work positions at other agencies and organizations (including transfer or rotation to work as commune-level cadres and civil servants) when accepted to work as civil servants at the district level or higher do not have to take an exam.

Officials who leave their positions can be assigned to work as civil servants.

Along with that, supplement the regulation on cases where cadres who cease to perform their duties (due to the end of their term or cessation of their duties before the end of their term but not due to disciplinary reasons) are arranged to work as civil servants at their current workplace if there is still a suitable job position and they meet all the standards and conditions without having to go through the acceptance procedure.

For civil servants and those working in the armed forces and cryptography, when admitted to civil service, only tests and assessments are conducted in the form of interviews, instead of having to take written tests or written and interviewed as per current regulations.

Regarding the probationary regime in recruitment and admission, the Ministry of Home Affairs proposes to amend the regulations on conditions in cases where probationary regime is not required.

In case of having had an internship period in a position suitable for the recruited and accepted job position but not having enough internship period according to regulations, it will be deducted from the internship period.

Regarding civil servant promotion, it is proposed to remove the regulation that the Ministry of Home Affairs has opinions on the promotion plan and quota for the promotion exam from specialist or equivalent to senior specialist or equivalent.

Along with that, from staff or equivalent to officer or equivalent, from officer or equivalent to specialist or equivalent to implement the policy of decentralization to ministries, branches and localities.

Amend regulations on cases of promotion consideration and principles of promotion consideration, supplement regulations on promotion consideration when there are achievements in public service activities in the direction of expanding standards and conditions on achievements to be considered for promotion compared to regulations in Decree 138.

Supplementing regulations that the Ministry of Home Affairs is responsible for developing and providing free shared software for ministries, branches and localities to use in organizing promotion exams to ensure consistency in the implementation process and save costs.

At the same time, applying science and technology in distributing question and answer banks ensures confidentiality, agencies do not have to send people directly to the Ministry of Home Affairs to receive question and answer banks.

Supplementing regulations on how to identify on-site human resources

Regarding the process of appointing civil servants to leadership and management positions, the draft adds regulations on determining the composition of the leadership team (step 1).

Accordingly, in principle, the authority belongs to the head and deputy head of the competent appointing agency.

Regulations on the competent authority for appointment may decentralize and authorize the head and deputy head of the agency, organization or unit that is directly subordinate to the competent authority for appointment (in all cases, it must ensure the participation of representatives of the Party Committee at the same level of the agency, organization or unit with the expected personnel to be appointed and the head and deputy head of the agency, organization or unit where the personnel is expected to be appointed).

Supplementing regulations for ministries, branches and localities to specify the authority, process, appointment procedures, responsibility for organizing meetings at each step, and specifically decide on the participants at each step in the appointment process for leadership and management positions within the scope of responsibility.

Ensure compliance with Party regulations and regulations in this Decree to ensure proper authority according to decentralization.

Supplementing regulations on how to determine on-site human resources. Specifically, on-site human resources are determined to be planned for the position or title expected to be appointed at the working unit or planned for the equivalent position or title or higher of a constituent unit at the same level within the same competent authority./.
