Ministry of Education and Training agrees to abolish exams to promote teacher titles

The Ministry of Education and Training affirmed that the teachers' proposal to abolish the form of professional title promotion exam is well-founded and currently the Ministry of Home Affairs is advising the Government to abolish this form of professional title promotion exam.

On August 4, the Department of Teachers and Educational Managers under the Ministry of Education and Training provided information to answer a number of questions during the implementation of Circular No. 08/2023/TT-BGDDT amending and supplementing a number of articles of Circulars No. 01/2021/TT-BGDDT, 02/2021/TT-BGDDT, 03/2021/TT-BGDDT, 04/2021/TT-BGDDT dated February 2, 2021 regulating codes, professional title standards and appointment and salary arrangement for teaching staff in public preschool and general education institutions, effective from May 30, 2023.

Teachers' proposal to abolish promotion exams is well-founded

Specifically, regarding the proposal by teachers to eliminate the form of professional title promotion exams, a representative of the Department of Teachers and Education Management Officers said that the regulations on professional title standards for civil servants and promotion of professional titles for civil servants in various sectors and fields are implemented according to the general regulations of the National Assembly in the 2010 Law on Civil Servants and the Law on Amendments and Supplements to a number of articles of the Law on Cadres, Civil Servants and the Law on Civil Servants. At the same time, it is implemented according to the detailed instructions of the Government in Decree No. 115/2020/ND-CP dated September 25, 2023 regulating the recruitment, use and management of civil servants.

Accordingly, the promotion of professional titles from a lower rank to the next higher rank in the same professional field is carried out through the form of examination and consideration (Clause 2, Article 31 of the 2010 Law on Civil Servants and Clause 2, Article 29 of Decree No. 115/2020/ND-CP). The organization of promotion of professional titles by examination or consideration at the local level is at the discretion of the agency or unit with the authority to organize the examination or consideration of promotion of professional titles according to the provisions of law. The Ministry of Education and Training does not have the authority to abolish the regulation on examination for promotion of professional titles of teachers and also does not have the authority to propose that localities implement a unified form of consideration for promotion.

However, the teachers' proposal to abolish the form of professional title promotion exams is well-founded. The Ministry of Education and Training received a document requesting comments from the Ministry of Home Affairs on abolishing the form of professional title promotion exams in the draft decree amending and supplementing a number of articles of Decree No. 115/2020/ND-CP, the Ministry of Education and Training has responded in writing in agreement with this content. Currently, the Ministry of Home Affairs is advising the Government to abolish the form of professional title promotion exams.

The Ministry of Education and Training recommends that localities, based on practical situations, consider and choose appropriate forms to organize the promotion of teachers' professional titles in order to create favorable conditions for the team and ensure the identification of teachers who are truly worthy of promotion of professional titles on the basis of the principles of equality, publicity, transparency, objectivity and compliance with the law.

Teachers are not required to submit training certificates, computer certificates, or foreign language certificates.

Currently, some localities when appointing or transferring preschool, primary and secondary school teachers to corresponding professional titles still require teachers to submit training certificates according to professional title standards, IT certificates, and foreign language certificates. This makes the appointment and transfer of professional titles difficult and inconsistent.

Regarding this issue, the Ministry of Education and Training said that the appointment of professional titles of Preschool, Primary and Secondary School teachers is implemented according to the provisions of Article 7 of Circulars No. 01, 02, 03/2021/TT-BGDDT, which have been amended and supplemented in Clause 9, Article 1, Clause 7, Article 2, Clause 8, Article 3 of Circular No. 08/2023/TT-BGDDT.

Accordingly, when making appointments and transferring the professional title ranking from the old regulations to the corresponding professional title rank according to the provisions of Circulars No. 01/2021/TT-BGDDT, 02/2021/TT-BGDDT, 03/2021/TT-BGDDT, it is only based on the training level standards and the time holding the next lower rank, without requiring teachers to have evidence of training certificates according to the professional title standards of the appointed rank and IT and foreign language certificates for the standards on the ability to apply information technology and the ability to use foreign languages ​​or ethnic minority languages ​​according to the requirements of the job position.

The Ministry also noted that Clause 2, Article 5 of Circular No. 08/2023/TT-BGDDT stipulates that "teachers are not required to provide evidence of performing the duties of the rank when appointed to the corresponding rank according to the provisions of Circulars No. 01/2021/TT-BGDDT, 02/2021/TT-BGDDT, 03/2021/TT-BGDDT, 04/2021/TT-BGDDT."

No regulation that 9 years of rank must be university level

Another issue that has not been uniformly implemented in some places is the determination of the total time of holding the rank (at least 9 years) as the basis for appointment and transfer from the old professional title of Primary and Secondary School Teacher Grade II to the new professional title of Primary and Secondary School Teacher Grade II. Some localities require that these 9 years must be 9 years for teachers who have achieved university degrees.

Responding to this, the Ministry of Education and Training said that according to the amended regulations in Circular No. 08/2023/TT-BGDDT, the condition for teachers of the old Grade II Primary and Secondary School to be transferred to the new professional title of Primary and Secondary School Teachers of the new Grade II is that the total time holding the old Grade III and the old Grade II is at least 9 years (excluding the probationary period). In particular, the Ministry of Education and Training does not stipulate the condition of university level of training for the total time holding this rank. Therefore, the requirement of some localities that 9 years holding the old Grade III and the old Grade II must be 9 years for teachers to have achieved university level is incorrect.

Determining the time equivalent to the time holding the new professional title of grade III when considering the standards and conditions for registering for the exam or considering promotion of a professional title from grade III to grade II has not been implemented consistently among localities.

According to the amended regulations in Circular No. 08/2023/TT-BGDDT, the time to hold the old IV and III grades is determined to be equivalent to the time to hold the new III grade from the time the teacher reaches the standard level of training according to the regulations of the level of education. Thus, when primary and secondary school teachers reach the standard level of training of the level of education (university level), the time to hold the previous grades (including other equivalent times) is determined to be equivalent to the time to hold the new III grade./.
