Ministry of Industry and Trade deploys new tasks on granting non-preferential C/O

On the afternoon of April 22, the Ministry of Industry and Trade held a conference to disseminate and implement Decision No. 1103/QD-BCT dated April 21, 2025 of the Minister of Industry and Trade.

Attending the conference were Mr. Nguyen Anh Son - Director of the Import-Export Department; Deputy Directors: Tran Thanh Hai, Trinh Thi Thu Hien; civil servants of the Goods Origin Department (Import-Export Department); representatives of the Import-Export Management Department of localities.

The conference was chaired by the Import-Export Department, in coordination with the Department of E-commerce and Digital Economy, the Department of Trade Defense, the Ministry's Office, the Legal Department, the Industry and Trade Newspaper, and the Industry and Trade Magazine, organized in a combined form of in-person and online to disseminate and organize the implementation of Decision No. 1103/QD-BCT dated April 21, 2025 to officials and civil servants working at 18 regional Import-Export Management Departments.

From May 5, the right to issue non-preferential C/O, CNM and register REX codes from VCCI will be revoked.

Speaking at the conference, Mr. Nguyen Anh Son stated that, implementing the Law on Organization of the Government 2025, the Law on Organization of Local Government 2025, on April 21, 2025, the Minister of Industry and Trade signed and issued Decision No. 1103/QD-BCT on revoking the right to grant Certificates of Origin of goods, granting Certificates of unchanged origin of goods and receiving registration of codes for certificates of origin of goods under the general preferential tariff regime of Norway and Switzerland for the Vietnam Federation of Commerce and Industry.

Decision 1103/QD-BCT clearly states that the Minister of Industry and Trade revokes the right to issue Certificates of Origin (C/O), Certificates of Unchanged Origin (CNM) and receive registration of Certificate of Origin codes (REX codes) under the Generalized System of Preferences (GSP) of Norway and Switzerland authorized by the Minister of Industry and Trade to the Vietnam Federation of Commerce and Industry (VCCI).

Decision 1103/QD-BCT takes effect from April 21, 2025.

From April 21, 2025 to May 4, 2025, VCCI and the Ministry of Industry and Trade (through the Import-Export Department) are responsible for completing the procedures for handing over documents, certificates and related contents regarding the organization of the issuance of C/O form A, C/O form B, non-preferential C/O according to the regulations of the importing country, CNM, C/O form GSTP and registration of REX code.

From May 5, 2025, VCCI will stop issuing all types of C/O form A, C/O form B, non-preferential C/O according to the regulations of the importing country, CNM, C/O form GSTP and REX code registration.

Mr. Nguyen Anh Son, Director of the Import-Export Department, delivered the opening speech at the conference.

Previously, on April 15, 2025, the Minister of Industry and Trade issued Directive No. 09/CT-BCT on strengthening state management of inspection and supervision of goods origin in the new situation. In which, the Import-Export Department was assigned to organize the implementation of the issuance of non-preferential C/Os, CNMs and REX code registration at the regional Import-Export Management Offices under the Import-Export Department after revoking the right to issue non-preferential C/Os, CNMs and REX code registration from VCCI.

According to the provisions of Decision No. 1103/QD-BCT, from May 5, 2025, in addition to issuing 18 preferential C/Os under Free Trade Agreements, the C/O issuing agencies of the Ministry of Industry and Trade will issue 10 types of non-preferential C/Os (including C/O form B, C/O form CNM, ...) and receive self-certification codes of origin of goods under the general preferential tariff regime of Norway and Switzerland.

Therefore, today's conference will focus on discussing the organization and implementation of issuing non-preferential C/Os, Certificates of Origin of Goods with unchanged origin, and receiving self-certification codes of origin of goods under the general preferential tariff regime of Norway and Switzerland starting from May 5, 2025.

Strengthening state management of inspection and supervision of goods origin in the new situation

Mr. Nguyen Anh Son also stated that, through this conference, the Import-Export Department requested the C/O Issuing Departments to pay attention to organizing the full, serious and responsible implementation of the issuance, inspection and verification of C/O according to the provisions of Decree No. 31/2018/ND-CP and the directives of the Minister. Directive No. 06/CT-BCT dated June 11, 2024 of the Minister of Industry and Trade on strengthening state management of origin of exported goods in the current period. Notice No. 394/TB-BCT on the direction of Minister Nguyen Hong Dien on strengthening state management of origin of goods. Directive 09/CT-BCT dated April 15, 2025 of the Minister of Industry and Trade on strengthening state management of inspection and supervision of origin of goods in the new situation.

In particular, in the context of complex and unpredictable developments in international trade, C/O issuing offices need to be ready to take on tasks and promote the prevention of fraud of goods origin by enhancing the effectiveness of C/O issuance and inspection, especially for enterprises with a sudden increase in the number of applications for issuance.

Proactively review and monitor the C/O issuance process, promptly report, proactively research and ask questions to propose solutions when detecting violations of the C/O issuance process, origin fraud, and strengthen the organization and implementation of inspection and verification of goods origin at production facilities (before and after C/O issuance) according to the provisions of Circular No. 39/2018/TT-BCT.

“I hope that after this Conference, the C/O issuing offices will improve their professional expertise in regulations on origin of goods related to non-preferential C/Os, Certificates of unchanged origin of goods and the acceptance of self-certification codes of origin of goods under the general preferential tariff regime of Norway and Switzerland. At the same time, strengthen management, assessment and necessary notes when considering C/O application dossiers of enterprises to meet the assigned tasks in the new situation” , Mr. Nguyen Anh Son emphasized.

Ms. Trinh Thi Thu Hien, Deputy Director of the Import-Export Department, delivered a concluding speech at the conference.

At the Conference, the Import-Export Department focused on disseminating tasks related to the organization and implementation of granting non-preferential C/Os, CNMs and REX codes, including:

Firstly, introduce regulations on origin of goods for non-preferential C/O forms according to the requirements of importing countries and register REX codes;

Second, announcement of policy Decision 1103/QD-BCT;

Third , announce the organization of reception and coordination between regional Import-Export Management Departments and C/O Issuing Teams under VCCI;

Fourth, instructions on dossier components, dossier appraisal process and related notes for issuing C/O and registering REX code;

Fifth, training on the procedures for issuing electronic C/O, collecting electronic C/O fees and processing related electronic data;

In order to enhance professional exchanges, ensure smooth implementation of non-preferential C/O, CNM and REX codes, avoid interruptions and create favorable conditions for businesses, from April 25 to 26, 2025, the Import-Export Department continues to organize a conference to evaluate the C/O issuance work in the first quarter of 2025 and focus on disseminating and training on contents related to the implementation of non-preferential C/O, CNM and REX codes.

In the context of the fast and unpredictable developments in international trade, in order to proactively adapt to the new situation, with the goal of promoting balanced and sustainable trade, ensuring the harmonious interests of Vietnam with partner countries and not affecting international commitments on the origin of goods that Vietnam participates in, the management of goods origin is one of the important tasks for import and export activities and is extremely necessary to improve the competitiveness of enterprises in the world market.

Currently, the Import-Export Department is continuing to closely coordinate with relevant functional units to carry out assigned tasks, ensure the prevention of fraud of goods origin and create favorable conditions for businesses.
