On the afternoon of July 29, according to information from the Department of Trade Defense, Ministry of Industry and Trade, on July 26, 2024, the Ministry of Industry and Trade issued Decision No. 1985/QD-BCT on investigating and applying anti-dumping measures on some hot-rolled steel products originating from India and China.
The decision to investigate was based on a request filed by domestic manufacturers under the provisions of the Foreign Trade Management Law, alleging that hot-rolled steel manufacturers from India and China were dumping the product into Vietnam, causing damage to the domestic manufacturing industry.
After receiving the request dossier, the Investigation Agency (Department of Trade Defense) reviewed it, requested the requesting party to supplement information, clarify some allegations in the dossier and conduct an appraisal according to regulations.
The Trade Defense Department said that during the process of reviewing the request dossier, the Investigation Agency sought opinions from relevant agencies and units. In addition to the information provided by relevant agencies and units, the Investigation Agency received opinions from a number of enterprises producing galvanized steel and steel pipes that are using hot-rolled steel as raw materials. The Investigation Agency will carefully consider and evaluate these opinions during the investigation of the case based on the data collected and verified by the Investigation Agency and will be reflected in the investigation conclusion.
Based on the investigation decision, the data collection period to assess dumping behavior is from July 1, 2023 to June 30, 2024, the data collection period to assess damage to the domestic manufacturing industry is 03 years, from July 1, 2021 to June 30, 2024.
According to the law, after initiating the investigation, the Investigation Agency will send the investigation questionnaire to the relevant parties to collect information for analysis and assessment: The level of dumping; damage to the domestic hot-rolled steel industry; and (the causal relationship between the dumping behavior and damage to the domestic industry. The Investigation Agency encourages the relevant parties to cooperate in providing complete and accurate information as requested by the Investigation Agency to ensure their rights.
The Investigation Agency will conduct an investigation and re-verification of the information provided by the relevant parties before completing the official investigation conclusion on the case. At the same time, the Investigation Agency will also organize a public consultation for the relevant parties to directly exchange, provide information, and express their views on the case before making a final conclusion on the case.
According to the provisions of the Law on Foreign Trade Management, the investigation shall be completed within 12 months from the date of the decision to investigate. In special cases, this period may be extended but the total investigation period shall not exceed 18 months.
