The investigation will be conducted in accordance with Vietnam's trade defense laws and will take effect from the signing date of July 26, 2024.

According to the notice attached to this decision of the Ministry of Industry and Trade, on March 19, 2024, this agency received a request for investigation to apply anti-dumping measures on some hot-rolled steel products originating from India and China from two enterprises representing the domestic manufacturing industry, namely Hoa Phat Dung Quat Steel Joint Stock Company and Formosa Hung Nghiep Iron and Steel Company Limited.

Based on the request dossier, the Investigation Agency has conducted an appraisal and issued official dispatches requesting additional information and clarification on the scope of products, the basis for determining dumping behavior as well as signs of causing or threatening to cause significant damage to the domestic manufacturing industry and the causal relationship between dumping behavior and damage to the domestic manufacturing industry.

By May 31, 2024, the Investigation Agency had conducted an assessment and issued official dispatches requesting additional information and clarification of relevant information, and then confirmed that the Request Document was complete and valid.

The investigation agency also sent a letter to the embassies of these two countries in Vietnam informing them of the receipt of complete and valid request documents.

The investigating authority also determined that the party requesting anti-dumping measures met the requirement of representativeness of the domestic industry and had clear evidence that the dumped imports were the cause of significant injury to the domestic industry.

The requesting party has also provided reasonable grounds to prove the dumping of the goods proposed for investigation and has provided data to determine the dumping margin of the goods proposed for investigation from the Republic of India at 22.27% and the People's Republic of China at 27.83%.

The Ministry of Industry and Trade said that in case the final conclusion of the Investigation Agency determines that there is significant damage or threat of causing significant damage to the domestic manufacturing industry, the Minister of Industry and Trade may decide to apply anti-dumping tax with retroactive effect.

Anti-dumping tax is applied retroactively to imported goods within 90 days before the application of temporary anti-dumping tax if the imported goods are determined to be dumped; the volume or quantity of dumped goods imported into Vietnam increases rapidly during the period from the time of investigation to the application of temporary anti-dumping tax and causes irreparable damage to the domestic manufacturing industry.

Accordingly, hot-rolled steel products (HRC) originating from India and China under investigation are classified according to the following HS codes: 7208.25.00, 7208.26.00, 7208.27.19, 7208.27.99, 7208.36.00, 7208.37.00, 7208.38.00, 7208.39.20, 7208.39.40, 7208.39.90, 7208.51.00, 7208.52.00, 7208.53.00, 7208.54.90, 7208.90.90, 7211.14.15, 7211.14.16, 7211.14.19, 7211.19.13, 7211.19.19, 7211.90.12, 7211.90.19, 7224.30.90, 7225.99.90, 7226.91.10, 7226.91.90, 7226.99.19, 7226.99.99 (case code AD20).
