In recent days, Binh Thuan Provincial Police have invited a series of people who filed complaints against Nguyen Van Thao (aka Thao “lui” or Bay Thao, 57 years old) to come to work to assist in the investigation process.
This development took place after the Ministry of Public Security coordinated with Binh Thuan Provincial Police to search the villa of Thao “lui”’s family along the Ben Loi River, Xuan An Ward, Phan Thiet City on the afternoon of June 3. Three days later, the police arrested Thao “lui” who was hiding in Ho Chi Minh City.
Currently, the Ministry of Public Security is expanding its investigation into cases related to Thao's gang in other localities.
How did the "faded" Thao gang operate?
In recent days, the developments of the Ministry of Public Security and the Binh Thuan Provincial Police investigating and searching the house of Thao “lui” have both surprised and delighted local people. Because Thao “lui”’s gang has been rampant, causing fear for many years, and has only now been dealt with.
According to sources, Thao's gang has been the black credit boss in Phan Thiet City and surrounding areas for many years. Thao is also known as the owner of a famous karaoke restaurant in Phan Thiet, and has activities to protect other business locations.
Sources revealed that Thao's gang was investigated for its rampant activities of occupying people's houses and land and business projects, causing instability in security and order and affecting the local investment environment.
A typical case, since 2018, Thao “lui” has led dozens of people to brazenly cut down trees, destroy property and occupy the house of Ms. Nguyen Thi Thuy Trang (52 years old) on a land area of thousands of square meters in Phu Hai ward, Phan Thiet city. This started from 2 years before, a relative of Thao “lui” asked to buy 6 sao of land from Ms. Trang and only deposited a part of the money and then kept quiet.
When land prices were high, Thao “lui”’s group brought a large number of people to openly occupy Ms. Trang’s house and land. In addition, in mid-2019, Thao “lui”’s group with dozens of people came to destroy the fence, beat people and invaded the land of Mr. Ma Tan Phuong (47 years old, living in Ho Chi Minh City), right next to Ms. Trang’s land.
In a typical case, Thao “lui” gang took advantage of the social distancing period due to the Covid-19 pandemic to blatantly occupy and build solid structures on a 2.2-hectare plot of land belonging to the King Sea complex resort project in Tien Thanh commune, Phan Thiet city, which the People’s Committee of Binh Thuan province had decided many years ago to allocate land to Dai Thanh Quang Company Limited (headquartered in Ho Chi Minh City), as the investor. Thao “lui”’s way of dealing with this was to spread the word that he had bought this land with a handwritten document in 2004 from a person who has now passed away.
Government shirking responsibility?
What makes people angry is that Thao “lui”’s gang-like activities have been going on openly, causing instability for a long time but the local government has not been able to handle it. Public opinion is asking whether the government is passing the buck between different levels? Does Thao “lui” have connections in the locality?
The case of Ms. Nguyen Thuy Trang, Mr. Ma Tan Phuong... had a petition for help and denunciation 4 years ago at the Phan Thiet City government and the provincial level but it has not been processed. Similarly, other victims such as: Nguyen Hong Phuoc (65 years old, residing in Phan Thiet City), Mr. Pham Van Dan (45 years old, residing in Ham Thuan Nam district), Mr. Vo Ngoc Tuan (32 years old)... when there was a petition, this unit transferred the petition to another unit for a long time, without being processed.
In the case of Thao "lui"'s group invading the King Sea project, this is a typical example of the gang-like project encroachment that has emerged in Binh Thuan in recent years, is difficult to handle and has seriously affected the province's investment environment.
For nearly 2 years, representatives of Dai Thanh Quang Company have filed complaints everywhere. During that time, the Secretary and Chairman of the Provincial People's Committee issued a document directing the Provincial Police, relevant departments and Phan Thiet City authorities to resolve the complaint of Dai Thanh Quang Company. Phan Thiet City People's Committee even requested the police to "establish a special investigation project related to land encroachment and disturbance of security and order" occurring at the King Sea project.
However, the case has been prolonged and recently handed over to the commune level for handling. Tien Thanh Commune People's Committee invited the parties to work. Mr. Thao "disappeared" without any legal evidence to prove the purchase - sale or ownership of the occupied land. In February 2023, the Commune People's Committee coordinated with units of Phan Thiet City People's Committee to measure and draw up a record of administrative violations against Mr. Thao for land occupation.
However, illegal constructions on the land built by Mr. Thao and a gang occupying the land continue, as if challenging the government.
To prolong the case, Mr. Thao sued the People's Committee of Binh Thuan province at the Provincial People's Court, requesting to cancel two decisions issued by this agency in 2005 regarding the land lease to Dai Thanh Quang Company. The noteworthy detail is that Mr. Thao has no land use history, does not have the types of papers and documents stipulated in Clause 1, Article 50 of the 2003 Land Law, and the land was proven to be "clean land" when the Provincial People's Committee assigned it to Dai Thanh Quang Company in 2005, but the Provincial People's Court still accepted the case.
When complaining, the representative of Dai Thanh Quang Company raised the question, is this delay to let Thao "lose" pressure and negotiate with the business?
Thao “lui”’s gang has been rampant in Binh Thuan for many years, people’s petitions and denunciations have been passed around, the handling process has been prolonged without any end, causing a loss of trust in a part of the government. Or like the land area for the King Sea project of Dai Thanh Quang Company that was invaded by Thao “lui”’s gang for a long time, causing damage to the business, with the risk of the project being revoked, who is responsible?
Currently, people expect the Ministry of Public Security and Binh Thuan Provincial Police to thoroughly handle Thao "lui" gang, quickly return the land assets so that people can stabilize their lives after years of hardship and the enterprise can continue to implement the project after a long time of calling for help everywhere, suffering so much damage.
Land encroachment for project projects is still complicated in Binh Thuan In 2022, Secretary of the Binh Thuan Provincial Party Committee Duong Van An signed an official dispatch to agencies, units, and socio-political organizations requesting to strengthen land management, strictly handle the situation of organized land encroachment, with hooliganism, causing insecurity and disorder in the locality, affecting the province's investment environment and the effectiveness and efficiency of State management in the fields of natural resources and land. However, the land encroachment in the locality is still complicated. At present, in the King Sea project alone, not only Thao's group has occupied 2.2 hectares, but some residents and brokers have also taken advantage of the situation to encroach and file complaints demanding compensation. This affects the timely implementation of the project and the investment environment in the area, and needs to be thoroughly handled by Binh Thuan province soon. |
