The Ministry of Public Security is seeking comments on a draft decree on administrative penalties for violations of road traffic order and safety. The draft stipulates that in addition to fines, some violations will result in confiscation of vehicles.
Cases of motorcycle confiscation
According to the draft, motorbike drivers will have their vehicles confiscated if they re-offend or repeatedly violate the following acts:
Keep both hands off the wheel while driving, use your feet to drive, sit on one side or lie on the seat while driving, change drivers while the vehicle is moving, turn around to drive, or drive blindfolded.
Driving erratically or weaving on urban and suburban roads. Driving on one wheel of a two-wheeled vehicle, or on two wheels of a three-wheeled vehicle. Driving in groups of two or more vehicles at a speed exceeding the prescribed speed limit.
Also according to the draft, if the above acts are committed without a vehicle registration certificate or using a vehicle registration certificate not issued by a competent authority, with incorrect chassis number or engine number, or with an erased certificate without proof of the vehicle's origin, the vehicle will be confiscated.
In addition, cyclists, motorbike riders, and other rudimentary vehicles will have their vehicles confiscated if they re-offend or repeatedly violate the following acts: Driving in a zigzag manner, swerving, chasing each other on the road; riding a bicycle, motorbike on one wheel, or riding a cyclo on two wheels.
Car confiscation case
The draft stipulates cases where automobiles (including trailers or semi-trailers being pulled along) and similar vehicles, passenger vehicles, and four-wheeled motorized cargo vehicles are confiscated if:
Drivers driving vehicles (including trailers and semi-trailers) that are past their expiration date on the road. Drivers driving vehicles manufactured or assembled in violation of regulations (including agricultural vehicles subject to suspension from road use, trailers and semi-trailers towed).
These acts will result in confiscation of the vehicle (except for cars with 10 seats or more used for passenger transport business with a usage period exceeding the business conditions of the registered business form, but not more than 20 years from the year of manufacture; cars with less than 10 seats used for passenger transport business). The act of driving without a vehicle registration certificate as prescribed, or using an expired vehicle registration certificate (including trailers and semi-trailers).
In addition, when performing the above acts without a vehicle registration certificate or using a vehicle registration certificate not issued by a competent authority, with incorrect chassis number or engine number of the vehicle or with erased information (including trailers and semi-trailers) without being able to prove the origin of the vehicle (without documents, certificates of vehicle ownership transfer or documents, certificates of legal vehicle origin), the vehicle will also be confiscated.
Also according to the draft regulation, vehicles will be confiscated when driving cars to race illegally on the road (except for animals pulled or ridden)...
