Regulation No. 114 of the Politburo on controlling power and preventing corruption and negativity in personnel work clearly states the responsibilities of Party committees, Party organizations, and collective leadership; heads of Party committees, Party organizations, and collective leadership; heads of advisory agencies; and advisory staff in controlling power and preventing corruption and negativity in personnel work.
Must be exemplary in considering and arranging family members
In which, the Party Committee, Party organization, and leadership group will transfer the working position, area, and field for staff, monitors, and personnel officers who violate discipline, have bad public opinion, or when necessary.
Standing member of the Secretariat Truong Thi Mai has just signed Regulation No. 114 of the Politburo on controlling power and preventing corruption and negativity in personnel work.
In particular, do not arrange for people with family relationships to simultaneously hold the following positions: Member of the same standing committee of the Party Committee, Party executive committee, Party delegation; collective leadership of agencies and units; head and deputy head of the same locality, agency, unit.
In addition, Party committees, Party organizations, and leadership collectives must not arrange for people with family relationships to simultaneously hold the positions of head of Party committees or head of administrative agencies and heads of agencies: Home Affairs, Inspection, Finance, Banking, Tax, Customs, Industry and Trade, Investment Planning, Natural Resources and Environment, Military, Police, Court, Procuracy at the Central level or at the same level in a locality.
In case there is no personnel plan that meets the requirements and the personnel is a highly trusted family member, it must be reported to and approved by the immediate superior Party Committee before being arranged.
For positions under the management of the Party Committee or Party organization directly under the Central Committee, they must report to the Central Organizing Committee; positions under the management of the Central Committee must report to the Central Organizing Committee to report to the competent authority.
The head of the Party Committee, Party organization, and leadership collective must be exemplary in considering and arranging people with family or acquaintance relationships to hold the position of head of the agency or affiliated unit; and to hold other leadership and management positions.
The regulation also clearly states the responsibility of the head when there is a notice of retirement, notice of leave pending retirement, job transfer or being considered for discipline, inspection, examination when there are signs of violations, handling denunciations must report and get the consent of the standing committee of the immediate superior party committee before implementing the personnel work process.
The head of the Central Government's management agency must report to the Central Organizing Committee.
Voluntarily not run for election, not accept planning or appointment if not qualified or healthy enough
Regulation 114 also clearly states the responsibility of personnel to promptly, fully, accurately and clearly report the personal records of party members, cadres, civil servants and public employees and honestly declare assets and income according to regulations; voluntarily not run for election, not accept nomination, planning, appointment, conferment, promotion of ranks, rewards, regimes and policies if they themselves feel they do not meet the standards, conditions, qualities, prestige, capacity and health.
The Politburo strictly prohibits the dissemination of untrue information, false accusations, directly or through others, through mass media, or social networks, to promote oneself or lower the prestige of others in personnel work.
Regarding the responsibility for preventing and combating corruption and negativity in personnel work, the Politburo also issued a series of regulations, including protecting and promptly rewarding individuals who discover, reflect, provide information, and correctly denounce acts of corruption and negativity in personnel work; at the same time, strictly handling those who make false accusations that affect the reputation of others.
In case of violations of Regulation 114 by cadres, party members, civil servants and public employees, the competent authority shall consider and handle them according to regulations. At the same time, the competent authority shall consider and apply handling measures.
Specifically, those who are reprimanded will be considered for personnel planning after at least 12 months from the effective date of the reprimand decision. They will not be assigned to do staff work, professional work on organization, personnel, inspection, or auditing.
If warned, the person will be considered for dismissal. After at least 30 months from the effective date of the dismissal decision, the person will be considered for personnel planning. The person will not be assigned to do advisory work, professional work on organization, personnel, inspection, or auditing.
Those who are dismissed from office will be considered for personnel planning after at least 60 months from the effective date of the dismissal decision. They will not be assigned to do staff work, professional work on organization, personnel, inspection, or auditing.
If expelled from the Party, the competent authority should be proposed to consider forcing the employee to quit his job or terminate the labor contract.
For acts of corruption and negativity in personnel work that are concluded to be violations, the records will be transferred to the competent authorities for consideration and handling according to regulations.
This regulation takes effect from July 11, replacing Regulation No. 205-QD/TW, dated September 23, 2019 of the Politburo on controlling power in personnel work and combating the abuse of power and positions.
