Binh Thuan orients the plan for arranging cadres, civil servants and public employees when organizing local government at the commune level

Up to this point, the arrangement and merger of commune-level administrative units (AUUs) is following the set roadmap. From determining the arrangement plan to handling the personnel problem..., Binh Thuan province is focusing on implementing it methodically, with the highest determination.

Currently, the number of cadres, civil servants and part-time workers of 121 commune-level administrative units in the province who have arranged to be present is 3,771 people (of which, 1,291 are cadres, 1,241 are civil servants and 1,239 are part-time workers at the commune level).

According to Official Dispatch No. 03 dated April 15, 2025 of the Steering Committee for the arrangement of administrative units at all levels and the construction of a 2-level local government organization model, the average staffing level of each commune is expected to be about 32 staffing levels (excluding party and mass organizations). Transfer 100% of the existing district-level staffing levels to arrange staffing levels at the commune level (the current number of district-level staffing levels is 677 staffing levels). In the immediate future, maintain the current number of staffing levels of district-level and commune-level staffing levels to arrange work at the commune level and carry out the review and streamlining of staffing levels in conjunction with restructuring and improving the quality of the team to meet the requirements of the tasks, ensuring that within 5 years, it is basically in accordance with the Government's regulations.

Based on regulations and instructions of the Government and the Ministry of Home Affairs, provincial-level local authorities shall orient and guide commune-level local authorities in arranging commune-level cadres and civil servants and develop a roadmap for reviewing and streamlining staff in conjunction with restructuring and improving the quality of the team to meet task requirements, ensuring that within 5 years, it is basically in accordance with Government regulations.

Regarding non-professional workers at the commune, village and residential area levels, according to Official Dispatch No. 03 dated April 15, 2025 of the Steering Committee for the arrangement of administrative units at all levels and the development of a 2-level local government organization model: End the use of non-professional workers at the commune level from August 1, 2025; assign local authorities to consider and possibly arrange non-professional workers at the commune level who meet the requirements of the task to participate in work in villages and residential areas; implement a retirement policy for non-professional workers at the commune level who are not assigned work according to regulations. Maintain the current positions of non-professional workers at the village and residential area, including: Party Cell Secretary, Head of the Front Work Committee and Village and Residential Area Chief until the Central Government has new regulations.

Regarding the plan and roadmap for resolving policies and regimes for cadres and civil servants after the reorganization of administrative units: Due to maintaining the current number of cadres and civil servants at the district and commune levels to arrange work at the commune level, there will be no cadres and civil servants who need to resolve policies and regimes. When the new administrative unit comes into operation, the review and reduction of staff will be carried out in conjunction with restructuring and improving the quality of the team to meet the requirements of the task, ensuring that within 5 years, it is basically in accordance with the Government's regulations. Regarding the regimes and policies for cadres, civil servants, and non-professional workers at the commune level when implementing the reorganization of administrative units at the commune level: Preserve the current salary regime and policy and position allowances (if any) of cadres, civil servants, and public employees arranged to work at the new administrative unit at the commune level after the reorganization for a period of 6 months. After this period, the regimes, policies and position allowances will be implemented according to the provisions of law.

Officials and civil servants who are reorganized into administrative units, if eligible, will enjoy policies according to the following regulations: Decree No. 29/2023/ND-CP dated June 3, 2023 of the Government regulating staff streamlining; Decree No. 178/2024/ND-CP dated December 31, 2024 of the Government regulating policies and regimes for officials, civil servants, public employees, workers and armed forces in implementing the reorganization of the political system (amended and supplemented in Decree No. 67/2025/ND-CP dated March 15, 2025).

In case cadres and civil servants are laid off and enjoy the provincial reduction regime according to Decree No. 29 dated June 3, 2023 of the Government, they will also enjoy the severance support regime according to Resolution No. 12/2020/NQ-HDND dated July 22, 2020 of the People's Council of Binh Thuan province stipulating the severance support regime for cadres, civil servants, and non-professional workers at the commune, village, and residential area levels who are redundant due to organizational and personnel rearrangement and the monthly supplementary allowance regime for non-professional workers at the commune and residential area levels in the province. Part-time commune-level workers who meet the conditions shall implement the staff streamlining policy according to Decree No. 29/2023/ND-CP dated June 3, 2023 of the Government regulating staff streamlining and enjoy severance support according to Resolution No. 12/2020/NQ-HDND dated July 22, 2020 of the Provincial People's Council.

In case cadres and civil servants are laid off and enjoy the provincial reduction regime according to Decree 56/29/2023/ND-CP dated June 3, 2023 of the Government, they will also enjoy the severance support regime according to Resolution No. 12/2020/NQ-HDND dated July 22, 2020 of the People's Council of Binh Thuan province stipulating the severance support regime for cadres, civil servants, and non-professional workers at the commune, village, and residential area levels who are redundant due to organizational and personnel rearrangement and the monthly supplementary allowance regime for non-professional workers at the commune and residential area levels in the province. Part-time commune-level workers who meet the conditions shall implement the staff streamlining policy according to Decree No. 29/2023/ND-CP dated June 3, 2023 of the Government regulating staff streamlining and enjoy severance support according to Resolution No. 12/2020/NQ-HDND dated July 22, 2020 of the Provincial People's Council.
