Binh Dinh regulates conditions and minimum area for land division and consolidation.

In Binh Dinh, urban residential land after subdivision must have a minimum area of ​​40 m2; rural residential land must have a minimum area of ​​50 m2.

Binh Dinh Provincial People's Committee has just issued regulations on conditions and minimum area for land division and land consolidation for each type of land in the province.

According to regulations, land division and land consolidation must ensure the principles and conditions prescribed by the Land Law (in Article 146 and Clause 1, Clause 2, Clause 3, Article 220, Land Law No. 31/2024/QH15).

Regarding land division, Binh Dinh Provincial People's Committee requires that land plots formed from land division must not be smaller than the minimum area and size according to regulations and not include areas within the safety corridor of public works; not within conservation areas, historical - cultural relic areas, etc.

The land plot does not have a land recovery notice, land recovery decision or is not on the land recovery list in the annual land use plan of the district level approved by the competent authority; the land plot must be consistent with the detailed planning or zoning planning or general planning, district-level land use planning approved by the competent State agency.

In case of land division in case of resettlement land allocation, it is only carried out after the decision to adjust the planning is approved by the competent authority.

Regarding the area and minimum size after being divided, the People's Committee of Binh Dinh province stipulates that urban residential land after being divided must have a minimum area of ​​40 m2, and the width (frontage) and length (depth) of the land must be at least 3 m.

Rural residential land after being divided must ensure a minimum area of ​​50 m2, with a minimum width (frontage) and length (depth) of 4 m.

For non-agricultural land, the minimum area for separation of surplus non-agricultural land that is not residential land (not part of an investment project) is 100 m2, with width (frontage) and length dimensions of 5m or more.

For agricultural land, the People's Committee of Binh Dinh province stipulates that the area of ​​land for annual crops and salt production is 500 m2, with a width and length of 5 m or more; land for perennial crops and aquaculture is 1,000 m2, with a width and length of 10 m or more; production forest land is 5,000 m2, with a width and length of 50 m or more...

For other agricultural land, the land user whose land origin is not part of the investment project is 500 m2, with width and length dimensions of 5m or more...

In addition, regarding land consolidation, the People's Committee of Binh Dinh province mentioned, "now when proposing to consolidate land plots, the difference in land use fees and land registration tax must be calculated based on the land price with the highest frontage (except in cases where the land plot has transferred land use rights to another land user)".

This requirement applies to the case where a land plot adjacent to two or more roads has been permitted by a competent State agency to be divided into new plots of land, with the frontage of each separated plot of land adjacent to a road with different land prices and the purpose of use has been changed to residential land, land use fees and land registration tax have been paid.
