Not fully reflecting the spirit of Resolution No. 57-NQ/TW
The majority of National Assembly deputies agreed to the Report on a number of issues in receiving, explaining and revising the draft Law on Employment (amended), ensuring clear, substantive and concise regulations.
However, National Assembly delegate Tran Van Khai (Ha Nam) said that although there are many new points, the draft Law on Employment (amended) still does not fully reflect the spirit of Resolution No. 57-NQ/TW of the Politburo on breakthroughs in science and technology development, innovation and national digital transformation in 3 core points.

That is, the digital human resource development policy still lacks depth; the digital infrastructure of the labor market has not been promoted as a competitive advantage; the mechanism to promote creative employment is still vague, lacking breakthrough motivation.
Therefore, to overcome the above shortcomings and successfully implement Resolution 57, delegate Tran Van Khai said that the draft Law needs to be adjusted according to three focuses: developing digital human resources, perfecting the digital infrastructure of the labor market, and promoting creative employment.
Specifically, regarding the issue of digital human resource development, it is necessary to supplement regulations on the development of digital skills and high-tech human resources. The principle of “employing talents” should be included in the Law (a separate clause should be added in Article 4) to serve as a basis for attracting and rewarding experts in high-tech fields and encouraging businesses to recruit people with specialized expertise. In addition, there should be a retraining policy for workers to adapt to digital transformation, ensuring that no one is left behind.
Regarding the issue of perfecting the digital infrastructure of the labor market, building a unified, interconnected and user-friendly labor market information system, delegates proposed adding the principle of "open data" in the regulations on the labor market information system (possibly in Article 23 or Article 25), to ensure that labor market data is maximally public, so that businesses and workers can easily exploit information, analyze employment trends, thereby connecting supply and demand more effectively...

Regarding the issue of promoting creative jobs and perfecting regulations to motivate the development of new forms of jobs, jobs in the field of innovation, delegates proposed adding to Article 2 the definitions of "creative jobs" and "green jobs", as a basis for clearly identifying these types of jobs, allowing the Government to pilot a flexible management mechanism for emerging types of jobs in the digital economy - instead of banning them when there are no regulations, we allow supervised testing to both promote innovation and gradually perfect the legal framework...
"This amendment to the Law on Employment is a golden opportunity to institutionalize the strategic orientations of Resolution 57, turning employment policy into a national competitive advantage in the digital age. If the amendment focuses on the key areas of digital human resources, digital infrastructure and creative employment as proposed above, the new Law will help build a dynamic, smart labor market, attract talent, and support the realization of innovative ideas. Thereby, Vietnam's human resources will become the main driving force for the strong development of science, technology and innovation, contributing to soon making our country a developed, high-income country," emphasized delegate Tran Van Khai.
Decentralization of labor market information system exploitation to localities
Regarding the labor market information system (Article 23), the provisions of Clause 1 define the labor market information system as a tool for management, research, and policy making.
However, to comply with Resolution 42 of the Central Executive Committee on continuing to innovate and improve the quality of social policies, meeting the requirements of national construction and defense in the new period, National Assembly delegate Thach Phuoc Binh (Binh Phuoc) suggested adding content on flexibility, integration and efficiency.
Accordingly, additional regulations on integrating AI technology and big data to forecast labor are added to improve the ability to analyze the labor market in the context of international integration; clearly stating the need to update data in real time to ensure synchronization and connectivity with the data system on social security, unemployment insurance, and vocational education.
Also in Article 23, Clause 2 stipulates the connection of the labor market information system to other databases. However, to ensure the effectiveness of this regulation, delegate Thach Phuoc Binh suggested that it is necessary to clarify the technical standards when connecting, to avoid the situation of fragmented and asynchronous data. At the same time, it is necessary to supplement the mechanism for monitoring and inspecting data quality, ensuring accurate and transparent information.

Sharing this view, National Assembly delegate Nguyen Thi Thu Ha (Quang Ninh) suggested that in Clause 3, Article 23, it is necessary to add content on decentralization to localities. Accordingly, the central state management agency for employment shall preside over, coordinate the construction, management and operation of, and decentralize to localities the exploitation of the labor market information system.
"In fact, if localities are not decentralized to exploit the labor market information system, they cannot carry out management, research, policy making, labor market analysis, forecasting, and support for labor market agencies, organizations, businesses, and individuals participating in the labor market in the area. Thus, this decentralization really needs support from central agencies and decentralization to localities," said delegate Nguyen Thi Thu Ha.
