Defendant Su at trial
On November 11, 2024, Su went to plant rice on rented land in My Thanh hamlet, Dinh My commune. Seeing that the rice field continued to be damaged by rats, Su intended to string lead wire, connect it to the power source to trap rats. Su bought a 12V - 30Ah battery, a roll of lead wire and used 40 small pieces of wood about 25cm long, then brought it to the field; tied the lead wire to the small pieces of wood, stringed the lead wire about 3cm above the ground, and inserted it from the beginning to the end of the field bank, along a path about 60m long.
After setting up the lead wire, Su used the battery to connect the power. From December 14, 2024 to December 17, 2024, Su used the battery connected to the generator to convert and amplify the DC power from the 12V battery to an AC power source with a voltage of 356.3V - AC, connected to the lead wire to trap the mouse. Along the mouse trap line, Su attached 2 flashing lights to warn of danger from about 19 - 21 hours then cut off the power.
At around 6:00 p.m. on December 18, 2024, Su continued to bring the battery and tools to his rice field to trap mice. This time, Su strung a lead wire on the rice field of Mr. Ho Huu Kinh (born in 1984, living in the same My Thanh hamlet) about 100m long, with 2 flashing lights at the 2 ends of the lead wire. After connecting the electricity, Su went home to eat (his house was about 1km from the rice field).
At around 8:00 p.m. the same day, Nguyen Vinh Phu (born in 1988) and Duong Van Minh (born in 1983), residing in the same My Thanh hamlet, went to visit the fields. While pumping water, they discovered that Nguyen Tan Cuong (born in 1981, residing in Binh Hung 2 hamlet, Binh My commune, Chau Phu district) had stepped on Su's mousetrap and was electrocuted to death, so they went to Su's house to inform him. Su ran out to remove the electric clamp from the battery and found that Cuong was dead, so he went to Dinh My commune police station and confessed to the entire act. On December 24, 2024, Su was prosecuted and detained for investigation.
After the incident, Su's family voluntarily compensated the victim's family for the funeral expenses. During the investigation as well as at the first instance trial, Su confessed to his crime. The defendant said that he had never used electricity to trap rats before, and that he was aware that it was dangerous, but because he was impatient with the rice field being continuously damaged by rats, he used electricity, which resulted in the death of a person...
After considering the relevant circumstances and the victim's family representative's petition for a reduced sentence for the defendant, the Provincial People's Court decided to sentence the defendant Su to 3.5 years in prison for the crime of "Murder", as prescribed in Clause 2, Article 123, Penal Code...
Recently, the authorities have stepped up propaganda and warnings against using electric shocks to set traps in any form. However, some people still defy the law, deliberately violating it, causing tragic deaths.
