Identify the primary responsible agency
Presenting the Government's Proposal, Minister of Public Security To Lam said that the development and promulgation of the Law on Road Traffic Order and Safety stems from objective practical requirements, with the important goal of ensuring the lives, health and property of people participating in traffic, specifically identifying the state agency that is primarily responsible for road traffic order and safety, contributing to improving the quality and effectiveness of state management; overcoming the limitations and shortcomings of the current Road Traffic Law, in line with the development trend of our country's law and international practices.
The draft Law consists of 9 chapters and 81 articles. Incorporating the conclusions of the National Assembly Standing Committee, the draft Law has adjusted the scope of regulation to match the name and content of the Law, thereby transferring the provisions on means of transport and a number of provisions in the road transport chapter with content related to traffic order and safety from the draft Road Law to this draft Law. In addition, the draft Law supplements the explanation of terms and a number of contents on principles and policies on traffic order and safety, prohibited acts, and the database on road traffic order and safety to ensure comprehensiveness and practicality.

According to Minister To Lam, the draft Law has added a number of new regulations in line with the trend and progress of digital transformation, creating convenience for people. Accordingly, for one of the following documents: driver's license, vehicle registration certificate, inspection certificate, compulsory civil liability insurance certificate, in case the information of any document has been integrated into the electronic identification account, identity card according to regulations, it is not necessary to carry it.
The draft Law does not divide the driving license categories in detail like the 2008 Road Traffic Law, but only stipulates the principles for classifying driving licenses to ensure flexibility in case of changes in relevant international treaties to which Vietnam is a member. In addition, the draft Law has revised and supplemented the contents of the provisions to improve the effectiveness of prevention, detection and punishment of violations; change the patrol and inspection methods towards modern application; serve the objective and accurate handling of road traffic violations; prevent acts that harm honor, dignity, life, health, and resist law enforcement officers.
Separate content related to road transport
Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi, representative of the examining body, said that the Committee agreed with the necessity of promulgating the Law and that the Law on Road Traffic was promulgated in 2008. After 15 years of implementation, many provisions of the Law have revealed limitations and inadequacies, failing to meet the requirements of management work in this field. Furthermore, the Law on Road Traffic 2008 regulates both the field of road traffic infrastructure, road transport and the field of road traffic safety and order, so it does not cover all the contents of the field of road traffic safety and order, leading to inadequacies in state management work, requiring the promulgation of many documents guiding its implementation. The promulgation of this Law is necessary, in line with the Party's policies and meeting practical requirements.
Basically agreeing on the scope of the draft Law, the National Defense and Security Committee proposed to continue reviewing to further clarify the contents related to road transport regulated in the draft Law on Road Traffic Order and Safety and the draft Road Law for appropriate adjustment.
Regarding vehicles participating in road traffic (Chapter III), some opinions suggested considering the regulation that motor vehicles and specialized motorbikes participating in traffic must meet the conditions of "Having a journey monitoring device; a device to collect data, images of the driver, data, images to ensure journey safety according to regulations" because they believe that applying it to all types of motor vehicles is too broad and difficult to ensure feasibility.
Regarding the auction of car license plates, some opinions said that after the National Assembly issued the Resolution on piloting the auction of car license plates, although the pilot implementation period was not long, it initially proved the effectiveness and feasibility of this new policy. Therefore, it is recommended that it be stipulated in the draft Law soon to ensure compliance with the provisions of the Constitution.
For drivers of vehicles participating in road traffic (Chapter IV), many opinions suggest specifying the driving license class in the draft Law to ensure transparency and legal value, compatibility with the 1968 Vienna Convention and consistency with the classification of motor vehicles.
Regarding driving license testing (Article 53), many opinions suggested adding regulations on state management after driving license testing; at the same time, adding regulations on irregular inspections of training, testing, granting licenses, re-examining testing results, and granting driving licenses to ensure strictness.
