Kinhtedothi - On the afternoon of November 23, at the 8th Session, the 15th National Assembly passed a Resolution on "Continuing to improve the effectiveness and efficiency of implementing policies and laws on real estate market management and social housing development".
After listening to the National Assembly Standing Committee member and Chairman of the Economic Committee Vu Hong Thanh present the Report on receiving, explaining and revising the draft Resolution on "Continuing to improve the effectiveness and efficiency of implementing policies and laws on real estate market management and social housing development", the National Assembly voted to pass this Resolution.
Focus on land valuation
Accordingly, the Resolution of the National Assembly on "Continuing to improve the effectiveness and efficiency of implementing policies and laws on real estate market management and social housing development" resolves to assign the Government to immediately carry out the following tasks and solutions:
Regarding newly issued Laws related to real estate market management and social housing development such as the 2023 Law on Real Estate Business, the 2023 Housing Law, the 2023 Bidding Law, and the 2024 Land Law, it is recommended to immediately implement the following tasks and solutions: Focus on directing ministries, ministerial-level agencies, and localities to complete the issuance of detailed regulations and implementation instructions according to assigned authority. Continue to review and complete detailed regulations and implementation guidelines to ensure overcoming existing shortcomings and limitations in the 2015-2023 period and problems arising in the implementation of new regulations, creating a safe, complete, favorable, stable and feasible legal corridor for investment, production and business activities of enterprises and people's lives, especially transitional regulations, ensuring conditions for access and use of land and other resources in a fair, public and effective manner.
At the same time, focus on directing the guidance and implementation of laws on land finance, focusing on land valuation, construction, adjustment of land price lists and other related policies, ensuring the maintenance of a reasonable level of land-related costs as input costs of the economy, ensuring the harmony of interests of the State, land users and investors in the spirit of Resolution No. 18-NQ/TW dated June 16, 2022, the 5th Conference of the 13th Party Central Committee on continuing to innovate and perfect institutions and policies, improving the effectiveness and efficiency of land management and use, creating momentum to turn our country into a high-income developed country.
In addition, promptly issue full and detailed regulations and effectively organize the implementation of laws and resolutions related to real estate market management and social housing development after being approved by the National Assembly at the 8th Session, such as the Law on Urban and Rural Planning; Law on Geology and Minerals; Law on Fire Prevention, Fire Fighting and Rescue; Law on Notarization (amended); Law on Cultural Heritage (amended); Law on amending and supplementing a number of articles of the Law on Planning, Law on Investment, Law on Investment under the public-private partnership model and Law on Bidding; Resolution on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights and Resolution on specific mechanisms and policies to remove difficulties and obstacles for projects and land in the conclusions of inspections, examinations and judgments in Ho Chi Minh City, Da Nang City and Khanh Hoa Province.
Resolutely handle real estate projects facing difficulties and legal problems
For draft laws submitted to the National Assembly for comments at the 8th Session related to real estate market management and social housing development such as the Law on amending and supplementing a number of articles of the Law on Technical Standards and Regulations, submitted to the National Assembly at the 9th Session such as the Law on Urban Development Management: It is recommended to study to have a mechanism to resolve difficulties and obstacles in practice based on an objective assessment of the implementation process of legal provisions over time; clearly identify the causes of difficulties due to the provisions of the Law, detailed regulations, implementation instructions or the implementing organization to propose appropriate and feasible solutions.
At the same time, there must be appropriate solutions to thoroughly handle real estate projects that are facing difficulties, legal problems, and stagnation due to prolonged implementation and changes in laws over time based on comprehensive consideration of objective practical factors, specific historical circumstances, and full assessment of benefits, costs, and feasibility of solutions to ensure the legitimate rights of the State, people, and businesses, for the common and overall benefit, freeing up resources for the real estate market, creating momentum for socio-economic development; not "criminalizing" economic and civil relations; clarifying the connotation of "not legalizing violations".
Along with that, there are specific solutions and instructions for ministries, branches and localities to remove difficulties related to land management and use in the process of equitization of state-owned enterprises and divestment of state capital in enterprises; there are mechanisms and policies to handle cases where the land use plan after equitization of state-owned enterprises and divestment of state capital in enterprises is no longer consistent with the planning; there are specific solutions to remove difficulties in the implementation of signed build-transfer (BT) contracts, to be completed in 2025.
Propaganda and dissemination of laws in the field of real estate market management and social housing development
The Resolution assigns the Government to direct ministries, branches and localities to continue to carry out the following tasks: Improve the effectiveness of propaganda, dissemination, guidance and training on policies and laws in the field of real estate market management and social housing development, especially for newly issued legal documents. Have appropriate forms of propaganda and dissemination for Vietnamese people residing abroad.
At the same time, proactively review, amend, supplement, and issue new legal documents under its authority or propose to competent authorities to perfect regulations related to land, investment, planning, construction, and real estate business to ensure consistency, synchronization, connectivity, and convenience in terms of procedures; abolish unnecessary, overlapping, and unreasonable regulations; and clearly stipulate the overall procedures for implementing real estate projects.
