According to the National Competition Commission, in recent times, businesses have cooperated with artists, celebrities, especially with influential individuals on online platforms to advertise and introduce products and goods, which has become a popular method to reach consumers. This method not only brings positive communication effects but also contributes to promoting consumption activities in the digital economy.

In addition to positive results, in reality, there have been many cases of violations of the provisions of the Law on Consumer Protection 2023 and its implementing documents, negatively affecting consumer rights as well as reducing the transparency and health of the business environment.

Decree No. 55/2024/ND-CP of the Government detailing a number of articles of the Law on Consumer Rights Protection stipulates that an influencer is an expert, a prestigious person, a person who receives social attention in a specific field, industry, or profession, sponsored by a business organization or individual in any form to use the image, advice, or recommendations of this person to promote trade or encourage consumers to buy or use products, goods, or services.

Using influencers to promote products is an inevitable trend in the economy, contributing to promoting consumption and spreading information effectively. However, the rapid development of this form also poses an urgent requirement for transparency and honesty in providing information to consumers.

a) A person with qualifications, expertise and experience in a specific field or profession, recognized by a competent authority or organization;

b) Outstanding people with many achievements, contributions, and prestige in society, specific fields and professions, recognized by competent agencies and organizations;

c) People who are noticed by society, have a significant number of followers on the media or have accounts that are eligible to participate in advertising and business programs on digital platforms.
