This morning, February 14, Head of the Legal Committee of the Quang Tri Provincial People's Council Nguyen Van Khoi chaired a working session with the Department of Home Affairs on draft resolutions and submissions of the Provincial People's Committee on reorganizing specialized agencies under the Provincial People's Committee; regulations on support policies for cadres and civil servants implementing policies according to Decree No. 177/2024/ND-CP, Decree No. 178/2024/ND-CP submitted to the Provincial People's Council.

According to the report of the Department of Home Affairs, on January 3, 2025, the Department of Home Affairs issued Official Dispatch No. 10/SNV - CCVC requesting agencies, units, and localities to count the number of cadres, civil servants, public employees, and workers under their management who quit their jobs during the implementation of organizational restructuring, as a basis for assessing the impact of the policy and building appropriate support levels.
Pursuant to Decree No. 177/2024/ND-CP, Decree No. 178/2024/ND-CP and the number of people quitting their jobs of registered agencies, units and localities, the Department has developed 2 draft resolutions of the Provincial People's Council, including: Resolution stipulating support policies for cadres and civil servants implementing policies prescribed in Decree No. 177/2024/ND-CP dated December 31, 2024 of the Government on regimes and policies for cases of non-re-election, re-appointment and cadres quitting their jobs and retiring at will in Quang Tri province.
The Resolution stipulates support policies for cadres, civil servants, public employees, workers and part-time workers at the commune level in implementing the organizational arrangement in Quang Tri province; drafts a report of the Provincial People's Committee to submit to the Provincial People's Council and organizes the collection of opinions from agencies, units and localities to ensure compliance with the process of drafting and promulgating legal documents according to the simplified procedure.
After the deadline for comments, the Department of Home Affairs has compiled, received and explained comments; issued a policy impact assessment report; reviewed and completed the draft resolution and draft submission of the Provincial People's Committee to the Provincial People's Council...
On February 10, 2025, the Party Committee of the Provincial People's Committee held a meeting and agreed to submit to the Standing Committee of the Provincial Party Committee for comments on the above two draft resolutions.
On February 11, 2025, the Provincial Party Committee Standing Committee agreed on the calculation method and level of local support according to the report of the Party Committee of the Provincial People's Committee. However, regarding the subjects of application of the policy and the period of application of local policies for cases of unemployment under Decree No. 178/2024/ND-CP, there are still many issues that need to be clarified, with regulations to control and ensure local budgets in implementing the policy.
Based on legal regulations, opinions of agencies, units, localities as well as practical situation, the Department of Home Affairs has proposed 3 options.
Option 1 stipulates that the beneficiaries of local policies are all cases of early retirement and immediate termination of employment according to the provisions of Decree No. 178/2024/ND-CP.
Option 2 stipulates that the beneficiaries of local policies are those who retire early, quit their jobs immediately according to the provisions of Decree No. 178/2024/ND-CP and submit a resignation application to the Provincial Party Committee's Organizing Committee/Department of Home Affairs before February 20, 2025 according to Official Dispatch No. 2872 - CV/BTCTU dated February 11, 2025.

Regarding the application period, support is only provided to those who register to leave within 12 months from the effective date of the decision on organizational arrangement of the competent authority. Head of the Provincial People's Council's Legal Committee Nguyen Van Khoi agreed with the contents of the draft resolution and draft report of the Provincial People's Committee submitted to the Provincial People's Council. The Department of Home Affairs needs to pay attention to the subjects of application of the policy in the 3 proposed options.
