The Provincial Party Committee's Internal Affairs Committee intervenes in the case of unauthorized sale of assets during forced eviction in Nha Trang.

(NLDO) - The Internal Affairs Committee of Khanh Hoa Provincial Party Committee requested the People's Committee of Nha Trang City to report on the delay in resolving the petition related to the case of arbitrary sale of assets during enforcement.

Accordingly, the Khanh Hoa Provincial Party Committee's Internal Affairs Committee received a petition dated March 4, 2025 from Mr. To Van Huynh (residing at 9/2D Nguyen Thien Thuat, Loc Tho Ward, Nha Trang City). The petition reflects that the Nha Trang City People's Committee has not complied with the deadline for issuing a conclusion on the settlement of the complaint that was accepted in October 2024 according to the law; affecting the rights and legitimate interests of citizens.

Report to Provincial Party Committee, Investigation Police Agency to keep the petition

Performing assigned functions and tasks, after studying the content of the petition, the Provincial Party Committee's Internal Affairs Committee forwarded the petition to the Chairman of Nha Trang City People's Committee for consideration and direction to resolve it according to authority and legal regulations.

At the same time, the Provincial Party Committee's Internal Affairs Committee also requested to respond to citizens and report the results of the settlement to the Provincial Party Committee's Internal Affairs Committee for synthesis and reporting to the Provincial Party Committee Standing Committee according to regulations.

Khanh Hoa Provincial Party Committee's Internal Affairs Committee requested Nha Trang City People's Committee to respond to citizens and report the results of handling the case.

In another development, the Office of the Investigation Police Agency (IPA) of Khanh Hoa Provincial Police also announced the handling of Mr. To Van Huynh's petition.

According to the petition, during the enforcement process, there was an impact and damage to Mr. Huynh's family's assets that were not subject to enforcement. Therefore, Mr. Huynh requested to consider and handle the above actions of the Chairman of the People's Committee of Loc Tho Ward and related individuals.

Through verification, currently, the Nha Trang City Inspectorate is conducting an inspection of the enforcement of the decision to enforce Mr. Huynh's construction project without a construction permit.

Up to now, the above inspection has not had any results. Therefore, based on legal regulations, the Office of the Criminal Police Department of Khanh Hoa Province Police has proceeded to file the above petition.

Proposal to prosecute 2 crimes

Lawyer Le Van Thiep - Head of Toan Cau Law Office (Hanoi City), who provided legal assistance and protected the legal rights and interests of Mr. To Van Huynh - said that during the process of being assigned the task of implementing administrative decisions of Nha Trang City People's Committee to enforce violations at hotel No. 9/2D Nguyen Thien Thuat (Loc Tho Ward), there was an abuse of position and power to appropriate property.

Accordingly, all of Mr. Huynh’s legal assets were appropriated and transported out of the construction site to the place of consumption. Specifically, the actual value of all assets, including construction steel of all kinds according to the sales contract, was more than 1.2 billion VND; the fire prevention and fighting pipeline system was more than 817 million VND; the air conditioner was more than 288 million VND; the electrical system was more than 415 million VND and many other assets were all valuable when reused... with a total value of more than 2.7 billion VND.

Lawyer Thiep said that the above incident showed signs of violating two crimes: "Abuse of power and position to appropriate property" and "Lack of responsibility causing serious consequences".

The amount of steel that the construction unit arbitrarily transported to sell was recorded by surveillance cameras.

Regarding the act of "Abusing position and power to appropriate property", the lawyer said that all administrative decisions issued by the Nha Trang City People's Committee do not contain any content allowing individuals participating in enforcement to confiscate, seize or strip the project investor of property ownership.

According to the evidence provided by the investor, Mr. To Van Huynh, such as video clips, vehicle weighing slips, property purchase and sale locations, types of vehicles, etc., it has been shown that the appropriation and transportation of property by the group of individuals participating in the enforcement occurred many times. Thereby, hundreds of tons of construction steel and construction steel components, non-ferrous metals, fire prevention and fighting equipment and many other properties were appropriated.

According to regulations, the area where illegal construction works are enforced is strictly prohibited for all unrelated individuals and organizations. Thus, individuals who appropriate property can only commit the act when their names are on the list of the working group and they work at the construction site where the property is located.

Regarding the act of "Lack of responsibility causing serious consequences", the Chairman of the People's Committee of Loc Tho Ward and related individuals shall comply with the decision issued by the People's Committee of Nha Trang City and the plan to enforce the demolition of the violating construction. At the same time, strictly comply with the procedures and regulations according to the construction demolition plan that has been reviewed and approved to protect the property of the homeowner in accordance with the provisions of law.

To cause the incident, the Chairman of the Ward People's Committee and individuals were irresponsible in checking and supervising the implementation of the enforcement decision; did not properly perform their duties and tasks as well as violated the law, allowing the act of appropriating property of particularly large value and intentionally doing it many times.

Therefore, the Global Law Office has submitted a request to the Khanh Hoa Provincial Police Department to accept the complaint of Mr. To Van Huynh, investigate and verify to initiate a case, prosecute the accused so as not to let criminals escape. The initiation of a case is necessary to protect the rule of law, deter individuals, prevent the public, protect the rights and legitimate interests of citizens according to the provisions of law.
