On June 27, the Investigation Police Agency, Da Nang City Police issued decisions to prosecute the case, prosecute the accused, and temporarily detain Luong Thien Anh Tuan (47 years old, residing in Lien Chieu District, Da Nang City) for fraud and property appropriation.
According to the investigation, from August 6, 2019 to January 7, 2020, Tuan provided false information about the possibility of "running" procedures for granting land use right certificates, especially converting land use purposes from rice-growing land and cropland to residential land.
The investigation agency served the decision to prosecute Tuan.
Through that, Tuan defrauded Mr. D.VT and Ms. VTKP (both residing in Da Nang City) to buy 5 plots of land, appropriating a total of 1.7 billion VND.
Specifically, on August 6, 2019, Tuan sold to Mr. T. a plot of land with an area of 800 m2 in Hoa Chau commune (Hoa Vang district, Da Nang city) for 880 million VND, and committed to making a land use right certificate within 6 months at a cost of 400 million VND.
Then, on October 10, 2019, Tuan sold to Mr. T. a 1,200 m2 plot of land in Hoa Tien commune (Hoa Vang district) for 1.7 billion VND, committing to have a land use rights certificate within 6 months at a cost of 400 million VND.
Also in October 2019, Tuan sold Mr. T. an additional 1,000 m2 plot of land in Hoa Tien commune for 1.6 billion VND, also committing to complete paperwork within 6 months for 400 million VND.
In January 2020, Tuan sold two plots of land with areas of 1,500 m2 and 1,200 m2 in Hoa Tien commune for 1.4 and 1.5 billion VND respectively to Mr. T. and Ms. P.
Similar to the previous plots of land, Tuan offered to "run" paperwork, changing the purpose of using rice and crop land to residential land at a cost of 400 million VND/plot.
However, Mr. T. and Ms. P. waited patiently but still did not receive the land use right certificate, so they filed a complaint.
The investigation agency determined that Tuan received a total of 1.7 billion VND from Mr. T. and Ms. P., but in fact Tuan did not make a land use right certificate but used the money to invest and suffered losses.
Regarding the origin, the 5 plots of land mentioned above are rice fields, crop fields, and wastelands under the management of the People's Committees of Hoa Chau and Hoa Tien communes, and do not meet the conditions for granting land use right certificates. Currently, the investigation agency continues to expand the fraud cases caused by Tuan.
