India initiates anti-dumping investigation on Elastomeric Filament Yarn originating or imported from China and Vietnam

On March 28, 2025, the Directorate General of Trade Remedies (DGTR) of India notified the initiation of anti-dumping investigation on Elastomeric filament yarn originating or exported from China and Vietnam.

- Products under investigation: Elastomeric filament yarn with HS codes: 54024400 and 54041100. In the market, the yarn is known by some names such as Spandex or Elastane yarn, mainly used in the production of elastic clothing. Excluded from the scope of investigation are colored elastic yarn (except black), elastomeric yarns on beam, yarns with the brand name "Lycra", elastic yarn used for diapers. (For details of the product, please see the attached initiation notice, HS code is for reference only).

The above product has been investigated and imposed anti-dumping tax by India since 2016. However, in 2022, the Indian Ministry of Finance stopped imposing tax on this product after a final review. In the case initiated, this is the second time this product has been investigated for anti-dumping by India. Fiber products are also a regular item subject to trade defense investigations by other countries.

- Plaintiff: Indorama India Private Limited. The Plaintiff alleged that the import of the subject product from the above-mentioned countries has caused injury to the domestic industry.

- Product Classification Number (PCN): The Petitioner has proposed 9 PCN numbers (See attached notice). The DGTR requests interested parties to submit comments (with detailed explanations) on the scope of the products under investigation and on the PCN number (if any) within 15 days from the date of initiation notice (i.e. 12 April 2025). The PCN number is directly related to the comparison between normal selling price and export price, which helps to identify the differences in cost and price of different types of products covered by the product under investigation.

- Investigation period: (i) dumping: October 1, 2023 - September 30, 2024; (ii) damage: April 1, 2021 - March 31, 2022; April 1, 2022 - March 31, 2023; April 1, 2023 - March 31, 2024 and dumping investigation period.

- Deadline: Vietnamese manufacturing/exporting enterprises need to submit comments and the Investigation Questionnaire to DGTR at the email addresses: [email protected] , [email protected] and [email protected] within 30 days from the date of receipt of the initiation notice (ie April 27, 2025). If the above deadline is not met, DGTR may conclude that Vietnamese enterprises are not cooperating and using available data to calculate the dumping margin for enterprises). Enterprises can also send a letter to DGTR requesting an extension of time to respond to the Investigation Questionnaire and send it to DGTR early before the deadline expires.

Interested parties can register as interested parties and express their views on the case to DGTR; and also follow the updated developments of the case on DGTR website: https://www.dgtr.gov.in/

- Recommendation:

In order to promptly respond to the incident, the Department of Trade Remedies (DTR) recommends that the Association and Vietnamese enterprises producing and exporting investigated goods do the following:

- Review the export situation of investigated products to India;

- Carefully study India's anti-dumping investigation regulations;

- Consider sending comments on the investigated product and PCN code proposed by the plaintiff as well as other comments related to the case within the prescribed time limit and format;

- Submit the Response to the Survey Questionnaire within the prescribed time and format to avoid being considered uncooperative and using data adversely (consider using consulting services if necessary);

- Contact and coordinate closely with the PVTM Department to receive timely information and support.
