In recent years, the State management of natural resources and environment in the Northwestern provinces has basically achieved results. Many programs, actions, directives and plans on natural resources management and environmental protection have been implemented. Thereby, it has helped raise public awareness, and urgent environmental issues have gradually been paid attention to.
However, in addition, due to many subjective and objective reasons, the management of natural resources and environmental protection in some provinces still has some problems and faces many difficulties and challenges such as: The rate of complaints and lawsuits about land is still high, some urgent environmental issues have not been resolved; cross-border environmental impact issues due to economic integration are increasingly complex and unpredictable; the orientation of sustainable development and the policy of transforming the growth model towards a green economy pose increasingly high requirements for environmental protection...
At the workshop, representatives of the Departments of Natural Resources and Environment of the provinces discussed solutions to improve State management of land, minerals and environment.
According to Mr. Ngo Xuan Hung, Deputy Director of the Department of Natural Resources and Environment of Lai Chau province, currently, projects and works subject to land recovery and land use purpose conversion in Lai Chau province according to the provisions of Clause 1, Article 58 and Clause 3, Article 62 of the Land Law 2013 have been approved by the Lai Chau Provincial People's Council at previous sessions but must be adjusted and supplemented during the year and the land use plan must be adjusted and supplemented many times, making management and consulting work very difficult.
Determining specific land prices to calculate compensation when the State reclaims land for land plots that have won auctions for land use rights also faces many difficulties. Lai Chau province hopes to receive advice from the Departments of Natural Resources and Environment in the cluster to resolve difficulties and problems.
Discussing the difficulties in the management of natural resources and environment, Mr. Ha Manh Cuong, Deputy Director of the Department of Natural Resources and Environment of Yen Bai shared that Yen Bai is currently facing difficulties due to the lack of uniformity in the land database system in the province. Currently, Yen Bai has 4/9 districts and towns that have not completed the cadastral survey work, so there are difficulties in the work of surveying, making land records, checking and appraising land allocation and lease records; the quality of the land database system implemented under the "Project to Strengthen Land Management and Land Database of Yen Bai Province" is not high.
In Lao Cai, licensing for mineral recovery in hydroelectric reservoirs is difficult because legal regulations on management of sand and gravel in river beds and protection of river beds, banks and beaches stipulate auctioning of products recovered from maintenance and dredging projects in seaport waters and inland waterway waters ( no regulations on recovery of sand and gravel from dredging hydroelectric reservoirs). Therefore, it is still difficult to implement.
The management and use of minerals as landfill materials in Lao Cai also faces many shortcomings because "Clause 1, Article 2 of the 2010 Mineral Law stipulates that "Minerals are useful minerals and minerals naturally accumulated in solid, liquid, and gaseous forms existing underground and on the ground, including minerals and minerals in mine waste dumps." Thus, construction landfill materials (soil, cobbles, gravel, grit, etc.) (naturally accumulated) are minerals.
From the reality of natural resources and environment work, representatives of the Department of Natural Resources and Environment of the provinces also spent a lot of time sharing experiences and methods in each management and control task according to the characteristics of their province so that the provincial departments in the cluster can learn, find the best solutions to overcome difficulties and apply them to practical work in the coming time.
