The Law on Road Traffic Order and Safety, recently passed by the National Assembly on June 27th, will come into effect on January 1st, 2025.
The law comprises 8 chapters with 89 articles, regulating rules, means of transport, road traffic participants, command, control, patrol, inspection, handling of road traffic accidents, state management responsibilities, and the responsibilities of agencies, organizations, and individuals related to road traffic order and safety.
Article 9, in particular, lists 27 prohibited acts. Specifically:
Driving a motor vehicle on public roads without a driver's license as required by law; driving a specialized motorcycle on public roads without a driver's license or a certificate of training in traffic law, or a license or certificate for operating a specialized motorcycle.
Driving a vehicle on public roads while having alcohol in the blood or breath.
Driving a vehicle on public roads while under the influence of drugs or other stimulants prohibited by law.
Insulting, threatening, obstructing, resisting, or failing to comply with the orders, instructions, or inspection and control requests of law enforcement officers regarding the maintenance of road traffic order and safety.
Racing, organizing races, inciting, assisting, or encouraging illegal racing; driving vehicles recklessly, swerving, weaving, or revving engines continuously on public roads.
Using your hands to hold and operate a phone or other electronic device while driving a moving vehicle on a public road.
Handing over motor vehicles and specialized motorcycles to individuals who do not meet the legal requirements to operate them on public roads.
Bringing motor vehicles and specialized vehicles that do not meet technical safety and environmental protection regulations, and other vehicles that do not meet the conditions prescribed by law, into road traffic.
Importing, manufacturing, and assembling motor vehicles and specialized motorcycles that do not comply with regulations on technical safety and environmental protection.
Converting other types of motor vehicles into passenger vehicles, excluding conversion into passenger vehicles for national defense and security purposes.
Unauthorized modification; intentional tampering with or falsification of the odometer reading on a vehicle; illegal cutting, welding, erasing, altering, or re-stamping of the chassis number or engine number of motor vehicles and specialized vehicles.
Intentionally interfering with or altering the vehicle's control software or engine, which has been registered with the regulatory authority, for the purpose of fraudulently obtaining inspection, testing, or certification results; renting or borrowing motor vehicle parts solely for the purpose of conducting inspections.
Transporting goods exceeding the vehicle's total weight, axle load, or permitted dimensions, or exceeding the road's permitted load and dimensions without authorization from the management authority or without ensuring compliance with the requirements of this Law; transporting goods on a vehicle that is required to be secured but is not secured or is secured improperly; carrying more passengers than permitted by law.
Transporting prohibited goods, transporting illegally, or failing to fully comply with regulations regarding the transportation of dangerous goods and wildlife.
Threatening, insulting, competing with, or soliciting passengers; threatening or coercing passengers into using unwanted services; transferring or dropping off passengers, or other actions aimed at evading detection of overloaded vehicles or vehicles carrying more passengers than permitted by law.
Installing and using sound and lighting equipment on motor vehicles and specialized motorcycles disrupts road traffic order and safety.
Illegally producing, using, buying, or selling vehicle license plates; driving motor vehicles or specialized motorcycles with license plates not issued by competent state authorities, or with license plates in the wrong position; bending or obscuring license plates; altering the letters, numbers, color, shape, or size of vehicle license plates.
Disrupting the operation or falsifying data from vehicle tracking devices or cameras installed on vehicles as stipulated in this Law.
Destroying, damaging, or rendering inoperable road traffic control and monitoring equipment, or smart equipment supporting road traffic command and control.
Placing or leaving obstacles or other obstructions illegally on the road; scattering sharp objects or pouring slippery substances on the road; spilling soil, rocks, goods, construction materials, or waste on the road; dumping, discharging, or spilling chemicals or waste that endanger road traffic safety.
Obstructing people and vehicles from participating in road traffic; throwing bricks, soil, stones, sand, or other objects at people and vehicles participating in road traffic.
Taking advantage of or abusing the duty to ensure road traffic order and safety to commit illegal acts, harassment, and infringement upon the interests of the State, and the legitimate rights and interests of organizations and individuals.
Abusing one's position, authority, or profession, or that of others, to violate laws on road traffic order and safety, or to interfere with or influence the process of handling violations of laws on road traffic order and safety.
Using priority vehicle privileges when not performing duties as prescribed by law; installing and using priority signaling devices in violation of legal regulations.
Failure to declare, making false declarations, or providing untrue information or documents to evade responsibility when found to have violated laws on road traffic order and safety.
Fleeing after causing a road traffic accident to evade responsibility; intentionally failing to provide assistance to victims of a road traffic accident when circumstances permit; violating the life, health, or property of victims, those who caused the road traffic accident, or those who helped, rescued, or took victims to the hospital; exploiting a road traffic accident to assault, threaten, incite, exert pressure, disrupt order, or obstruct the handling of the road traffic accident.
Controlling flying objects, unmanned aircraft, and ultralight flying vehicles operating within road clearance limits in a way that obstructs or poses a safety risk to people and vehicles participating in road traffic, except for unmanned aircraft and ultralight flying vehicles that have been licensed to fly.
